(661 The Lands in the said James Heaths Bill mentioned to the said James Neale and his heires for the Consideration in the said James Heaths Bill Expressed as by the Deed may more at large appear that the said James Nealle and Elizabeth his wife the 10 day of Aprill 1702 by Deed indented duely Executed and inrolled granted the said Lands to Charles Edgerton deceased and his heires in franke Marriage with his Daughter Mary in which Deed the same James Neale Covenanted to warrent the said Land to the said Charles only ag.st him the said James and Elizabeth and against Charles Calvert in the BIll mentioned and all claimeing by from or under them or any of them as by the said Deed did no more at large appeare And the said James Neale said that he beleived the said Charles Edgerton some time after by Deed Conveyed the said Lands to the said James Heath and his heires but for what Consideracon knew not nor what Covenants was in the said Deed expressed that the said James Heath being dubious of the said James Neales title to the Lands for the Love and affeccon he bore his said Daughter Mary upon great paines charge and trouble by the instigation and motion of the said James Heath and to sell him at quiet procured a Release from Charles Calvert the eldest son and heire of the said W.m Calvert deced to the said James Neale and his heires with warranty to him the said Charles and all claimeing by from or under him as by the said Deed of Release did more fully and at large appeare And the said James Neale did further sett forth that the said Deed of Release was drawne with the proper hand writeing of the said James Heath who at the doeing thereof told the said James Neale that if he gott the same perfected by the said Charles Calvert he would Expect noe further or better title to the said Lands to which the said James Neale had before a Just and equitable Right and title that the said James Neale knew nothing of any Deed duely Executed Acknowledged or Enrolled from the said Charles to his brother Richard and if any veryly beleives was obtained by the said Richard by fraud on purpose to defeat the title of the said James Neale and all claimeing under him And the said Mary wife to the said Jermiah Adderton made answ.r that she beleived William Calvert Esq.r deceased by Deed bearing date the Twentyeth day of December 1681 or thereabouts granted |
