655. up her Right of Dower of the Lands and premisses Within Mentioned and Without being induced thereto by fears or threats of or ill usage by her said Husband or fear of his aspleasure before J Hepburn Received August 27.th 1765 of Alexander Campbell Four Shillings Ster.g as an Alienation fine on the within One hundred Acres of Land by order of the Honb.r Edward Lloyd Agent for the Right Honb.r the Lord Proprietary of Maryland 5 3/4 sides J Hepburn Recorded 24.th September 1765 Ex.d This Indenture made the Fourteenth day of September in the Year of our Lord one thousand seven hundred & Sixty five Between Basil Wheeler of Prince Georges County in the Province of Maryland of the one Part & William Sydebotham Attorney in Fact for Law.r Spencer Esq.r of Liverpoole & John Wheeler & George Wheeler of the Province of Maryland of the other part Whereas the said Basil Wheeler is justly indebted to the said Law Spencer one of his Credittors in the sum of Four hundred & fifty pounds Ster.g or upwards as by his account will appear and to several other Persons his Credittors and hath propos'd and agreed with the said William Sydebotham absolutely to resign Convey and assure unto the said Lawrance Spencer and others all that Part of a Tract of Land call'd Majors Choice and is the Second Bound Tree of a Tract of Land call'd Franklin the Land of M.r Garner in the N by W Line of William Hattons Land and running with the said Land South & by East untill it meets a deep gully and up and with the said gully to the Head of it Thence with a Streight Line untill it intersects a Line of John Hawkins's Land Thence with the said Line towards the old plantation till it meets a deep gully thence down the s.d gully until it intersects the Line of Franklin Thence with the said Line to the begining Tree containing P Estimation Seventy Acres more or Less and all and every share of Goods Wares & Merchandize in Partnership with his Brothers John & George Wheeler together with all other goods & Chattles of the said Basil Wheeler except as herein after excepted and Credits whatsoever of the said Basil Wheeler be such Creditts due in Partnership afs.d or duely Judgment Bond Bill or otherwise whatever wheresoever of from whomsoever to stand and remain in Trust for equal and proportionable use Benefit and advantage of all and every of his Credittors or such of them as shall come and consent in Writting under their hands and seals to this agreement at or before The fourteenth day of November next ensuing the date hereof and in all things Comply with the Terms and Conditions expressed herein and for and towards the paying satisfying and dischargeing the several Debts due and oweing or in proportion thereunto Now This Indenture Witnesseth that for and in consideration of the Covenants and Agreements herein after mentioned on the part and behalf of the said William Sydebotham John & George Wheeler their Executors Adm.rs and Assigns Covenanted and agreed to be performed and |
