656. and done the said Basil Wheeler hath granted bargained sold assigned Transfer'd and set over and by these presents doth grant bargain sell assign Transfer and set over unto the said William Sydebotham John & George Wheeler their Heirs Exec.rs Adm.rs and Assigns all that part of a Tract of Land call'd Majors Choice aforesaid and all and Singular his share of Good Wares and Merchandize in Partnership with the said John & George Wheeler together with all other Goods and Chattles and Credits Whatsoever of him the said Basil Wheeler be such Creditts due in Partnership afs.d or due by Judgment Bond Bill or otherwise howsoever or from whomsoever set down and express'd in the Schedal or Inventory delivered to the said William Sydebotham Attorney in Fact for the aforesaid Lawrance Spencer & John & Geo Wheeler excepting the Household Goods and Furniture of the said Basil Wheeler and Fifty Pounds Curr.t Money for which sum of Fifty Pounds Current Money the said Basil Wheeler shall immediately give his Bond to the said Lawrance Spencer John & George Wheeler payable in Five years for the use and In Trust for his Credittors aforesaid to have and to hold the said part of the said Tract of land Call'd Majors Choice aforesaid and to ask demand sue for and recover and receive all and Singular the said Goods Debts Sum and Sums of Money and other things Whatsoever by these presents granted bargain'd Sold Assign's Transfer'd and sett over or in any wise due owing or belonging to the said Basil Wheeler by or from all or any persons Named as Debtors in the said Schedule or Inventory unto the said William Sydebotham John & Geo Wheeler their Heirs Executors Adm.rs or Assigns together with all the Goods and Chattles of the said Basil Wheeler excepting the Household Goods & Furniture aforesaid and the Fifty pounds Current Money upon Trust Nevertheless and to and for the Intents and Purposes following That is to say to and for the Equal and proportionable use Benefit behoofe and Advantage of him the said Lawrance Spencer and all such other Creditors of the said Basil Wheeler as shall hereafter at or before the said Fourteenth Day of November next accept of the same in Manner and form aforesaid for and towards paying satisfying and dischargeing several Debts due and oweing or in proportion thereunto and not otherwise And the said William Sydebotham John & George Wheeler for themselves and for each of their Heirs Exec.rs and Administrators do Covenant promise and Agree to and with the said Basil Wheeler that they the said W.m Sydebotham John and George Wheeler their Heirs Executors & Adm.rs or some or one of them will with all Convenient Speed Cause his or their best means or Endeavours to Sell the said Part of the said Tract of Land call'd Majors Choice and the goods &c by suit in Law or Equity or otherwise to receive sue for recover all and every the said Debts Sum & Sums of Money and other things Mentioned Set down and express'd in the said Schedule or Inventory and after receipt or |
