640 Woodward and Mary Holmes or the Survivor of them or their Heirs of such survivor should make sale of the said Lands for the best price that could reasonably be had or obtained for the same which Monies so to be raised were directed by the said Last Will to be divided among the Persons mentioned therein for that purpose As by the said Last Will reference being thereunto had may more fully appear And Whereas the said Elizabeth Gin in and by her said Last Will in Writing gave and devised all her Estate and Effects in Maryland which Should be unsold at her decease between the Children of her late Sister the aforesaid Mary Woodward and the Survivors and Survivor of them as by the said Last Will reference being thereunto had may more fully appear And the said William Woodward and Mary Holmes are the only surviving Children of the said Mary Woodward deceased And Whereas the said Elizabeth Gin did not at any time during her lifetime dispose or make sale of the said Tracts or parcells of Land called The Land of Goshen and Cannons Delight or either of them or any part of them or either of them And Whereas the said William Woodward in his own right and the said Mary Holmes by the said William Woodward her Attorney thereto appointed by virtue of an Instrument of Procuration or Letter of Attorney to the said William Woodward from the said Mary Holmes duely executed acknowledged attested and entered among the records of the Provincial Court of Maryland on or about the eleventh day of February seventeen hundred and sixty four by Deeds of Lease and release did Grant and Convey to the Benjamin Tasker Charles Carroll Charles Carroll Barrister Daniel Dulany Walter Dulany and Charles Carroll the Younger their Heirs and Assigns as Tenements ^Tenants^ in Common the aforesaid two Tracts of Land called The Land of Goshen and Cannons Delight as by the said deeds also entered among the Records of the same Provincial Court reference being thereto had may fully appear Now this Indenture Witnesseth that the said Mary Holmes for and in Consideration of the sum of Seventy Nine Pounds & Ten Shillings Sterling to her in Hand paid by the said Benjamin Tasker Charles Carroll Charles Carroll Barrister at Law Daniel Dulany Walter Dulany and Charles Carroll the Younger at or before the Sealing and delivery of these presents the receipt whereof the said Mary Holmes doth hereby acknowledge and for divers good Causes and Considerations She the said Mary Holmes Hath granted bargained sold aliened released enfeoffed and Confirmed and by these presents Doth grant bargain sell alien release enfeoffe and Confirm unto the said Benjamin Tasker Charles Carroll Charles Carroll Barrister at Law Daniel Dulany Walter Dulany and Charles Carroll the Younger (in their Actual possession now being by virtue of a Bargain and sale to them thereof made for one year by Indenture bearing date the Payment before the day of the date of these presents and by force and opperation of the Statute for transferring uses into possession) (and) |
