624 indemnify and secure the s.d John & Denton Hammond from such Payments Penaltys Costs Damages & Charges as shall or may at Law or in Equity on Process issued on the Injunction Bond af.d so Executed by them and said William be reasonable ^recoverable^ or recovered against them and that it is but just & reasonable that they the s.d John & Denton Hammond & Each of them shou'd and ought to be by the said William well and sufficiently saved harmless indemnified and Secured against the same Now this Indenture Witnesseth That the said William Gaither for and in Consideration of the Premises and of the sum of Five Shillings Currency to him In Hand by s.d John Hammond and Denton Hammond being well and truly paid the Receipt whereof the s.d William doth hereby acknowledge and therewith confess himself to be fully content & satisfied He hath granted bargained & sold assigned and Sett over, and doth by these Presents grant bargain & sell assign and sett over unto them the said John Hammond and Denton Hammond and to their respective Heirs Executors Administrators and Assigns for ever (To be Tenants in Common thereof and not Joint tenants with right of Survivorship between them) all his the s.d William Gaither's Estate Right Title Interest and property of in and to that Part or Parcell of Land with its Appurtenances situate near the Head of Severn and lately purchased by s.d William of a certain John Philips the same being Part of a Larger Tract of Land called by the Name of the Mistake in Friendship and Containing Acres more or less Also his The said William Gaither's Store House at the Indian Landing Likewise his Equity of Redemption of all and singular the Premisses real and personal of Every Kind with their Appurtenances which are specified and particularized in the Mortgage afs.d made by s.d William to John and Philip Hammond as af.d and herein above referred to Together with his Growing Crop of Grain at his Dwelling Plantation on Severn and all and Singular his Chattels herein after Enumerated or Comprehended viz I say one Negro Man called Jack lately purchased by s.d William Gaither and being a bout thirty years of age with all his the said William's Stock of Creatures of Every Kind Viz one Horse Dun one other Horse Black one other Horse Ranter and one Mare Jeivel and another Mare Blaze with the Encrease of the two last named, Likewise nine head of black Cattle sorted and Eighteen Hogs also one Good Iron Shod Cart and several Ploughs with the Gear & Harness &C belonging unto s.d Cart & Ploughs and all other the Plantation Untensile with the House hold Furniture of Every Kind belonging unto said William Gaither and all and Singular his other Effects and Estate real & Personal of Every Kind tho the same be not herein particularized or Enumerated To have & To hold all & Every the Premisses real and Personal af.d and herein above mentioned referred to comprehended and Dispose of by s.d William or intended so to be in manner & Form as af.d unto |
