623) five came before me the Subscriber one of the right honourable the Lord Proprietary his Justices of the Provincial Court the within named George Shirley Thomas Watt and Mary Watt and Severally acknowledged the within Named ^ Instrument^ of Writing to be their respective Acts and Deed to and for the uses intents and purposes within mentioned & the Land and premisses therein mentioned and every part and parcell thereof to be the right and Estate of the same Thomas Watt his heirs and assigns for ever according to the true intent and meaning of the same Deed an 7 sides Geo Steuart Recorded 11.th Sept.r 1765 Ex.d This Indenture made this Fifth day of April in the year of our Lord seveventeen Hundred and sixty five Between William Gaither of Ann Arundel County Gentleman of the one Part and John Hammond and Denton Hammond Each of the County af.d Gent.n of the other Part Whereas the s.d John Hammond and Denton Hammond did on or about the third Day of July last past at the Special Instance and Request of the above named William Gaither bind themselves jointly and severally with and become Securities for him the s.d William in an Injunction Bond given by him for the Purposes therein mentioned and under the Penalty and Condition in said Bond specified and Expressed as Reference unto the same filed in the Chancery Court being had may appear And Whereas the Writ of Injunction thereon obtained and sued out by s.d William is at length (according to Information) dissolved and that this his Sureties by Name as af.d and Each of them are liable and likely to Satisfy and pay as well the Debt and Costs recovered at Law against the said William as also the Damages and Charges that the Court of Chancery may or shall Award against him for Delay of Execution on the Judgment at Law against him by his Process of Injunction af.d And For as much as the security heretofore made by said William unto s.d John Hammond and a certain Philip Hammond (by Indenture bearing Date the sixth Day of December Anno Dom one Thousand seven Hundred and sixty two and recorded in Ann Arundel County Land Records in Liber BB N.o 2 fol.s 740 741 742) and by him to be Assigned with the Assent of s.d William unto s.d Denton Hammond (and when thereunto required) jointly with John Hammond af.d is Deemed by Each and both of them insufficient to save Harmless indemnify |
