577 Dick Ann Chapman Executrix of the late William Chapman John Brice Esq.r & Benjamin Tasker Esq.r rateably and in proportion to the same that Shall be then due to them respectively and in case more money shall arise by such Sale as aforesaid & shall be actually received by the said James Dick his Heirs Ex.rs Administrators or Assigns than shall be sufficient to pay satisfy and discharge the said Costs Charges and Expences and also the said Debts & Interest that then the Ballance or Surplus thereof to be paid and delivered over to the said Samuel Chapman his Executors Administrators or Assigns And the said Samuel Chapman for himself his Heirs Executors & Administrators doth covenant promise and grant to & with the said James Dick his Heirs Executors Administrators and Assigns in manner and form following that is to say that he the said Samuel Chapman his Heirs Executors and Administrators the said Tracts pieces or parcells of Land with their Appurtenances and also the said Negroe Slaves and their Increase to him the said James Dick his heirs Executors Administrators and Assigns against all manner of Persons whatsoever shall and will warrant and for ever hereafter defend And that he the said Samuel Chapman the said sums of Money now due and oweing to the aforesaid James Dick Ann Chapman Executrix of the Late William Chapman John Brice Esq.r & Benjamin Tasker Esq.r together with legal Interest thereon to them the said James Dick Ann Chapman John Brice Esq.r & Benjamin Tasker Esq.r respectively ^their respective^ Executors Administrators or Assigns on or before the said Ninth day of July Next will well and truly pay but that if default shall be made in the payment thereof or of any part thereof that then he the said James Dick his heirs Executors Administrators or Assigns shall and may set up and expose to sale ^sell^ and convey the said Lands and Slaves or such part thereof as may be necessary and the monies arising by such Sale and Conveyance receive and apply in the manner herein before mentioned And further that he the said James Dick his Heirs Executors Administrators or Assigns shall not be charged or in any manner chargeable with or for any Monies or such sale as aforesaid |
