560 his wife To whose severall Deeds for Ascertaining the metes & Bounds afs.d Land Reference being had may further appear Containing by Estimation Five Hundred Acres more or Less &c.a To have and to Hold The said part or parcell of Tract of Land Called Piscattoway Forrest to me the said James Marshall my heires and Assignes for ever and to my own proper use & behoof Subject Nevertheless To the Provisoe following that is to say Provided Always and it was the True intent & Meaning of the said deed that if the s.d Francis King or any person on his behalf should well & Truely without fraud or Covin Pay or Satisfy unto me the s.d Francis ^James^ Marshall my heires Ex.rs & Adm.rs at or before the 1.st day of December next from the Date of this deed the afs.d Sum of £228 16 8 St.g & £99 19 2 Currency with Legal Interest for the same that then the above recited Bargain & Every Clause Therein Should be Absolutely void frustrate & of none Effect Provided also That the Possession & Enjoyment of the Premisses be in the said Francis King his heires & Assignes untill Default of payment be made And Whereas The s.d Francis King Hath well and Truly Paid & satisfyed unto me The s.d James Marshall the sum of £228 16 8 St.g & £99 19 2 Cur.y afs.d the receipt whereof is hereby acknowledged & myself Fully satisfyd Contented & paid in Consideration of his having the s.d Part or Parcell of a Tract of Land Called Piscattoway Forrest Containing Five Hundred Acres Mortgaged as afs.d to be Absolutely Released to him the s.d Francis King his Heires and Assignes for ever Now This Indenture Witnesseth That I s.d James Marshall do for and in Consideration of the sum of £228 16 8 Ster.g & £99 19 2 Currency To me in hand paid and myself therewith fully Satisfyed as afs.d do by These Presents for myself my heires Ex.rs & Adm.rs Remise Release & For Ever Quit Claim to the s.d Francis King his heires & Assignes for ever all my Right Title Interest Property Claim & Demand whatsoever of in and to the af.d Part or Parcell of a Tract of Land Called Piscattoway Forrest In the mortgage deed before specified Contain.g Five Hundred Acres w.th the Respective Appurtenances thereunto Belonging To Have and to Hold the s.d Part or Parcell of Tract of Land w.th the ^its Respective^ Appurtenances unto him the s.d Francis King his heires and Assignes for ever Hereafter Absolutely Discharged & Barred from all Action of right title Claim Property Interest or Demand whatever From me the s.d Francis ^James^ Marshall my Heires Ex.rs & Adm.rs and of and from any person or persons Claiming from by or under me them or Either of them and I the s.d James Marshall do for myself my heires Ex.rs & Adm.rs Further |
