525 Premisses and Appurtenances to the said Bargained Peice or parcel of Land belonging And all Ways Waters Water courses and Emoluments thereunto in any wise appertaining with the Reversion and Reversions Remainder and Remainders Rents Proffits and Issues thereof To have and to hold the said Bargained peice or parcel of Land with the Premisses and appurtenances and every part and parcel thereof unto the said John Beale Bordley his Heirs and Assigns for ever and to his and their only proper use and behoofe And the said Edward Fell for himself and his Heirs doth hereby Covenant and Grant and agree to and with the said John Beale Bordley his Heirs and Assigns in manner and form following, that is to say that the said Bargained peice or Parcel of Land with the Premisses and appurtenances & every part and parcel thereof is free and Clear of and from all manner of former or other Gifts Grants Bargains sales Leases Jointures Dowers Mortgages Entailes or other Incumbrances whatsoever That he the said Edward Fell at the time of signing and Sealing these presents is lawfully & Rightfully seized of and in the said Bargained peice or parcel of Land and every part and parcel; thereof by a Good sure Perfect and Absolute Estate of Inheritance in Fee simple and hath good Right full power and lawfull and Absolute Authority to Convey and Assure the same unto the said John Beale Bordley his Heirs and Assigns for ever And that he the said Edward Fell and his Heirs shall and will Warrant and defend the said Bargained peice or parcel of Land with the premisses and appurtenances and every part and parcel thereof unto the said John Beale Bordley his Heirs and Assigns for ever against all and all manner of Person or Persons whatsoever That he the said Edward Fell and his heirs shall and will forever hereafter leave and keep open and unobstructed all the Streets Lanes and Ways by him heretofore laid out and intended for ^Publick &^ Common use on the aforesaid tract of Land and place laid out by him the said Edward Fell for a Town on and about the said Fells Point for the Benefit and use of the said John Beale Bordley his Heirs and Assigns and as Common & Publick Streets Lanes and Ways for the passage of all manner of Persons Carriages and things whatsoever And Lastly that he the said Edward Fell and his heirs shall and will at any time or times hereafter at the reasonable request of the said John Beale Bordley his heirs or assigns and at his or their Costs and Charges in the Law make do Execute acknowledge and perfect any such other Deed act matter or thing as shall be by the said John Beale Bordley his Heirs or Assigns devised advised or required for the better and more surer Confirming the said Bargained peice or parcel of Land with the Premisses and appurtenances and every part and parcel thereof unto the said John Beale Bordley his heirs and assigns for ever In witness whereof the said Edward Fell hath hereunto set his Hand and affixed his seal the day and year first above written Signed sealed and delivered in presence of Edward Fell seal NRuxton Gay Benjamin Rogers On the back of the aforegoing Deed it is thus written Received this 18.th day of March 1765 of M.r John Beale Bordley One hundred and twenty pounds sterling Money being the Consideration Money mentioned in the within Deed as Witness my Hand Edward Fell Witnessed by NRuxton Gay On the 18.th day of March 1765 Came the within named Edward Fell before us the Subscribers two Justices of the Peace for Baltimore County and acknowledged the within Instrument of writing to be his |
