523 Testament request that his son in Law Samuel Pottinger deceased should give the said Moiety or half part of the said Two hundred acres of Land unto his son Robert being the son of his then present wife the said Robert Tylers Daughter Now this Indenture further witnesseth that for as much as the aforesaid Samuel Pottenger died Intestate and did not give the aforesaid Moiety or one half part of the aforesaid Land called Howertons Range unto his son Robert as aforesaid That I Samuel Pottenger (son and Heir at Law of Samuel Pottenger deceased) as aforesaid in order to fulfill as much as may be the last Will and Testament of the aforesaid Robert Tyler and for the Natural Love and Affection which I bear unto my Brother Robert Pottinger and also for and in Consid.n of the sum of five shillings sterling to me in hand paid at and before the Ensealing and delivery of these Presents by the aforesaid Robert Pottenger the receipt whereof I do hereby acknowledge and therewith to be fully satisfied Contented and paid and thereof and every part thereof doth hereby Clearly acquit exonerate and discharge the said Robert Pottinger his Heirs and Assigns for ever and Do hereby give Grant Bargain sell Alien Enfeofe Transfer and Confirm And by these presents hath given Granted Bargained sold Aliened Enfeofed Transferred and Confirmed unto the said Robert Pottenger his heirs and Assigns for ever all that Moiety or one half of the aforesaid two hundred Acres of Land called Howertons Range (alias Parrets manner) situate lying and being in Prince Georges County; and the Land whereon the aforesaid Robert Pottenger doth now dwell Together with all and singular the Houses Fences Yards Gardens Orchards and other appurtenances whatsoever thereunto belonging or in any wise appurtaining To have and to hold the aforesaid Moiety or one half part of the aforesaid two hundred acres of Land and Premisses with the appurtenances unto him the said Robert Pottinger his heirs and Assigns for ever (according to the true Intent and meaning of the Last Will and Testament of the aforesaid Robert Tyler reference being thereunto had more at Large may appear) to the only proper use and behoof of him the said Robert Pottenger his Heirs and Assigns for ever and to non other use Intent or purpose whatsoever and the said samuel Pottenger for himself his heirs Executors and Administrators Doth hereby covenant Promise Grant and agree to and with the aforesaid Robert Pottinger his heirs and Assigns that he the said Samuel Pottenger his heirs Executors and Administrators shall and will from time to time and at all times for ever hereafter well and truly Warrant and defend the aforementioned Land and premisses with the appurtenances unto him the said Robert Pottenger his heirs and Assigns for ever against all and all manner of Person or Persons Claiming or to Claim any Right Title or Interest whatsoever of in or unto the aforementioned Land and Premisses with the appurtenances or any part or parcel thereof from by or under him the said Samuel Pottinger And the said Samuel Pottenger doth hereby for himself his heirs Executors and Administrators further Covenant Promise Grant and agree to and with the aforesaid Robert Pottinger and the said Samuel Pottenger doth hereby for himself his heirs Executors and Administrators further Covenant Promise Grant and agree to and with the aforesaid Robert Pottenger his Heir sand Assigns that he the said Samuel Pottenger and his Heirs shall and will at all times hereafter at the reasonable Costs and Charges in the Law of him the said Robert Pottenger his Heirs and Assigns make do acknowledge suffer and Execute or Cause to be made done acknowledged suffered and Executed all and every such further Act or Acts thing or things devises conveyances and assurances in the Law as shall be reasonably devised advised or required for the further and more perfect Assurance |
