463 aforesaid (except as before accepted) to him the said Cornelius Garretson his Executors Administrators and Assigns and to have and to hold the other undivided Moiety of the same Part of the Tract of Land aforesaid (except as before excepted) to him the said Nathaniel Waters his Executors Administrators and Assigns from the day of the date hereof for and during and untill the full end and Term of Ninety nine Years Yielding and paying therefore ^Yearly and^ every Year during the said Term unto him the said Michael Ruley his Heirs Executors Administrators or Assigns the rent or sum of Twenty shillings Sterling Money upon the twentieth day of November and the said Cornelius Garretson and Nathaniel Waters for themselves and each of them their and each of their Heirs Executors Administrators and Assigns Do hereby Covenant Grant and Agree to and with the said Michael Ruley his Heirs Executors Administrators and Assigns in Manner and form following that is to say That they the said Cornelius Garretson and Nathaniel Waters their Heirs Executors Administrators or Assigns Yearly and every Year during the said Term of Ninety nine Years shall and will well and truly pay or cause to be Paid to the said Michael Ruley Heirs Executors Administrators or Assigns on the said twentieth day of November the said Yearly rent or sum of twenty shillings Sterling Money that the said Cornelius Garretson and Nathaniel Waters or either of them their or either of their Heirs Executors Administrators or Assigns shall not nor will not raise or cause to be raised the Waters of Fishing Creek aforesaid so as to Overflow the Meadows and Low Grounds or any part thereof of him the said Michael Ruley his Heirs Executors Administrators or Assigns Adjoining to the said hereby demised Premises and the said fishing Creek and that they the said Cornelius Garretson and Nathaniel Waters and each of them their and each of their Heirs Executors Administrators and Assigns shall and will in Case of high Tides & Freshes and other Casualties take every Necessary Step to Prevent such Overflowing of the Meadows and Low Ground aforesaid and every part thereof And to build and Compleatly finish a Tide Water Grist (Mill) |
