       with their and every of their Appurtenances unto him the said James Maccubbin
       his Heirs and Assigns to the only Proper use and behooff of him
       the said James Maccubbin his Heirs and Assigns forever subject
       Nevertheless to the Clause Condition Covenant or Proviso in the
       above recited Indenture mentioned for Redemption of the Premises af.d
       Provided alwais that this Present Writing of Assignment is upon
       this express Agreement that the said Robert Couden his Heirs Ext.rs
       nor Administrators shall be in any manner ^whatsoever^ liable or Answerable
       to the said James Maccubbin his Heirs Ext.rs Adm.rs or Assigns ^or^ either
       in law or equity for any Defect or Deficiency in Value of the Mortgaged
       Premises or for or in any manner respecting the Title or Estate therein
       In Witness whereof we have hereunto Interchangeably set our
       Hands and Affixed our Seals the day and Year first above Written
       Signed Sealed and Delivered                     Rob.t Couden      Seal
       in the Presence of
                   Reverdy Ghiselin        On the back of the aforegoing Deed was
                   William Steuart           thus Written Viz.t

       Aug.t 27.th 1764  Received of M.r James Maccubbin the sum of One hundred
       and four Pounds nine shillings and six Pence Current Money in
       Dollars at seven shillings & six Pence each being the Consideration of
       the within Deed                                       Rob.t Couden

                   Bennett Chew
                                             27.th August 1764  Then came Robert Couden within
       mentioned before us the Subscribers Two of his Lordships Justices of the
       Peace for Ann Arundel County and Acknowledged the within Instrument
       of Writing to be his Act and Deed and the Land & Premises therein
       Specified to be the Right and Estate of the within named James Maccubbin
       his Heirs and Assigns According to the true intent and
       Meaning of the same Deed               Reverdy Ghiselin
