424 against the said Josias Talburt the said Josias Talburt to recover in Value against the common Vouchee so that a Perfect recovery may thereupon be had and suffered and that the said Partys and the common Vouchee shall make do suffer and execute all and every matter or thing whatsoever meet Necessary and Convenient for the Prosecution of the said Recovery according to the Course of common Recoveries with single Voucher Whereupon a Writ of Seisin shall issue and be executed in due form of Law And it is hereby further Covenanted Granted and Agreed upon by and between the said Parties to these Presents that the said common Recovery to or in any other Manner to be had and suffered of the aforesaid Premises with the Appurtenances between the said Parties to these Presents shall enure and be Construed Adjudged and taken to be and enure to the use of the said Jesse Wilcoxon his Heirs and Assigns and to no other use intent or Purpose Whatsoever In Witness whereof the said Parties have hereunto set their Hands and Seals the day and Year first above Written Signed Sealed and Delivered Josias Talburt Seal in Presence of William Paca On the back of the aforegoing Deed was thus Written Viz.t William Cooke August the first 1764 Then received of the within named Jessee Wilcoxon the sum of five shillings Current Money being the Consideration of the within Deed Josias Talburt September the Twenty fifth 1764 Then came the within named Josias Talburt before me the Subscriber one of his Lordships Justices of the Provincial Court And Acknowledged the within Instrument of Writing to be his Act and Deed and the Land with the Appurtenances and the said Deed mentioned to be the Right and Estate of the within Jesse Wilcoxon his Heirs and Assigns forever According to the True intent and meaning of the within Deed Taken and Acknowledged 6 1/2 sd before me the day and Year af.d Jn.o Brice Recorded the 25.th Septem.r 1764 |
