311) hereby Covenants and Agrees to and with the said John Brice his Heirs Executors Administrators and Assignes that he the said Benjamin Welsh his Heirs Executors and Administrators the aforesaid Several and Respective Tracts or parcels of Land and Premisses with their each and every of their Rights Members and Appurtenances and Also the aforesaid Several Negroes with the Increase of the said Priss Cate Jamar Barbary Rachel Pegg Sall and Suek alias Susannah unto him the said John Brice his Heirs Executors Administrators and Assigns as well against him the said Benjamin the Welsh and his Heirs as against all other Persons Whatsoever shall and Will for ever Warrant and Defend by these Presents Provided always and it is the True intent and Meaning of these Presents that in Case the said Benjamin Welsh his Heirs Executors and Adm.rs shall well and Truly Pay or Cause to be Paid unto the above named John Brice his Executors Administrators or Assigns the aforesaid sum of Five hundred and forty five Pounds Sterling Money of Great Britain with legal Interest thereon by Good Bills of Exchange drawn on some Responsible Merchant in London at thirty days sight together with the Charge of Drawing and Recording this Indenture of or Deed of Mortgage at or upon the Tenth day of April which shall be in the Year of our Lord Christ one Thousand seven hundred Sixty and Six without Fraud or further delay then this Indenture or Deed or Mortgage to be Voyd and of no Effect Else to be and remain in full Force & Virtue in Law And the said Benjamin Welsh for himself his Heirs Executors and Administrators hereby further Covenants and Agrees to and with the said John Brice his Heirs Executors Administrators and Assigns that he the said Benjamin Welsh his Heirs Executors and Adm.rs (the) |
