306 and Demand Whatsoever of him the said Skipworth Coale of in to or out of the aforesaid Land and Premisses and every Part thereof To have and to Hold the said Tract or Parcell of Land and all and Singular the Premisses with the Rights Members and Appurtenances to him the said John Weems his Heirs and Assigns to the intent and Purpose that the said John Weems may be and become Perfect Tenant of the Freehold and Inheritance of the said Premisses that a common Recovery may be had and Suffered against him in such Manner as is herein after mentioned and for that Purpose it is hereby Covenanted Granted and Agreed by and between all the said Parties to these Presents that before the end of the next Provincial Court one or more Writ or Writs of entry Sur Disseisin enlepost at the Costs and charges of him the said John Weems shall and may be brought and Prosecuted against him the said John Weems in the name of him the said John Hall as Plaintiff or Demandant therein and for the aforesaid Tract or Parcell of Land with the Appurtenances by such name or names Quantity Quality Number or Content of Acres or other Certainties and Descriptions as shall be Apt and Convenient in that behalf to which Writ or Writs the said John Weems shall Appear gratis in his proper Person Person or by his Attorney or Attorneys Lawfull Authorized and shall Vouch to Warrant the Premisses the said Skipworth Coale who shall Likewise Appear Gratis in his Proper Person or by his Attorney or Attorneys lawfully Authorized and shall and will enter into the said Warranty and Vouch over to Warranty the same Premisses the Common Vouchee and who shall thereupon Appear and enter into the said Warranty and after Imparlance make Default and such further and other Proceedings shall be therein had so that one or more Good and Perfect Common Recovery or Recoveries with with Double Voucher shall and (may) |
