29. July 17.th 1763 Received of M.r William Hall Four Shillings and one Penny sterling for the Use of the Lord Baltimore being the Alianation Fine on the within One hundred and two Acres of Land by virtue of a Commission from Edward Lloyd Esq.r his said Lordships Agent and receiver General Benj.a Beall Recorded the 18th day of July 1763 Ex.d This Indenture made this Sixth day of September in the Year seventeen hundred and sixty two Between William Courts of Charles County Planter of the one part and Henry Smith Hawkins of the County aforesaid Planter of the other part Whereas for the Docking barring and Extinguishing the Estates Tail and Reversions or Remainders thereupon Expectant or depending of and in Lands and Appurtenances herein after mentioned the said Henry Smith Hawkins as Demandant did hereto forth at the request Cost and Charge of the aforesaid William Courts Prosecute and sue forth out of his Lordships High Court of Chancery his said Lordships Writ of Entry sur disseissin en le post against him the said William Courts returnable and returned to the Provincial Court at Annapolis on the second Tuesday of this Instant Whereby the said Henry Smith Hawkins did Demand against the Said William Courts All that Tract or Parcel of Land Called ^Rich Hill lying and being in Charles County containing three hundred Acres and also All that Tract or Parcel of Land Called^ Thomas's Addition lying and being in Charles County Containing Eighty Three Acres with the Appurtenances to the said Two tracts or parcels of Lands aforesaid belonging to which writs the Said William Courts did appear in his proper Person and Vouch thereof to Warranty the Common Vouchee of the same Court and such further and other proceedings his thereupon had that the said Henry Smith Hawkins did by Judgment of same Court recover his Seisin against the afd William Courts of and in the Demanded Premisses and that the Said William Courts did recover over in Value against the Common Vouchee Whereby a Common Recovery of the said Premisses hath been had and suffered Now this Indenture Witnesseth that for the setiling and declaring the Intent and Uses of the Said Recovery and for and in Consideration of of Five shillings Currency Money by him the said Henry Smith Hawkins to the afd William Courts in hand paid the Receipt whereof is hereby Acknowledged it is hereby Covenanted Granted and agreed and declared by and Between the said parties to these presents that the said Common Recovery so as aforesaid or in any other Manner had and Suffered and the Execution thereof from and immediately after the same |
