26.

       Agree to and with him the said Nicholas Maccubbin his heirs and Assigns By these
       Presents that he the said Michael Devanbaugh and his heirs shall and will from Time to time
       and at all times here after Warrant and Defend the aforesaid Lot of Land and premisses thereunto
       Belonging with the Appurtenances herein before granted Bargained Sold aliened enfeoffed and
       Confirmed from and against all manner of persons whatsoever Provided always that it is
       the true Intent and meaning of these presents that if the said Michael Devanbaugh his
       Executors or Administrators shall well and truly pay unto the said Nicholas Maccubbin
       his Executors Administrators or Assigns the said Sum of one hundred sixty seven pounds sterling
       By Bills of Exchange at thirty days Sight payable in London at the Dwelling house of
       the said Nicholas Maccubbin in the City aforesaid with the Lawfull Interest thereof also
       the Charge of Drawing and recording the said Mortgage at or Before the first day of July
       next ensuing that then these presents shall be void of none Effect Otherwise to be and remain
       in full force and the said Michael Devanbaugh doe By these presents bind my self
       my Heirs Executors and Administrators to pay the said Money and the Interest thereof
       accordingly   In Witness whereof the said Michael Devanbaugh hath hereunto
       set his hand and affixed his seale the day and year first above written

       Signed Sealed & Delivered                     Mirsnl Jin Penr Cay      s
       in the Presence of

          Thomas Harwood and Joseph Gaither

          On the Back of the aforegoing Deed was thus Written

       On the 8th day of July 1763   Came before me the subscriber one of his Lordships
       Justices of the Provincial Court the within Named Michael Devanbaugh party
       to the within presents and did acknowledged the same to be his Act and Deed and
       the Lot of Land and Premisses therein Bargained and Sold to be the Estate
       Property Right & Title of the within named Nicholas Maccubbin his Heirs
       Executors Administrators and Assigns for ever According to the Directions of the
       Act of Assembly in such Cases made and provided and according to the true
       Intent and meaning of the within Instrument of Writing Geo Steuart

       Received the day and Year within Mentioned of the within Named Nicholas
       Maccubbin the within mentioned Sum of One Hundred and Sixty Seven
       Pounds Sterling Money it being the Consideration Money within Mentioned
       Test Tho.s Harwood & Joseph Gaither                                       Mirsnl Jin Pnr Cay
