x.d      This Indenture made this third day of January in the Year
       Seventeen hundred and Sixty Four   Between Hutchinson Parker
       and Alethea his Wife of the one part and James Marshall of the other part
       Whereas the aforesaid Hutchinson Parker and Alethea his Wife long before the
       Eleventh day of May seventeen hundred and fifty four had from a decline in their
       Fortunes which were at first very ample for their handsome support and maintenance
       become poor and almost destitute of necessary subsistance and from an unhappy
       disagreement between them had lived seperate for some Time the whole or chiefly
       all the Estate left of their Original Fortune consisting of the Lands and Appurtenances
       herein after mentioned lying near Piscataway in Prince Georges County which
       had been Conveyed to John Smith late of S.t Leonards in Calvert County deceased
       the Brother of her the Said Alethea Parker in Trust for the Use of her the said
       Alethea Parker and the heirs of her Body by her said Husband begotten remainder
       in Fee to the aforesaid John Smith      And Whereas the aforesaid
       John Smith the Brother of her the said Alethea Parker died some TIme
       in or about the Year seventeen hundred and Fifty three seized of a considerable
       Real Estate and Possessed of a large personal Estate having first made his
       Testament and last Will in Writing by which after several Bequests therein he
       devised and Bequeathed in the following Words      Item I leave to my dearest
       Sister Alethea Parker the Use of my whole Estate after the above Legacies are
       Complied with during her Life and afterwards in the same Will devised and bequeathed
       over as well the Lands as the Residue of his Personal Estate upon the Death of her the said
       Alethea Parker And soon after the Death of the Said John Smith she the said A^l^ethea
       Parker had actually retained Council Council to file a Bill in Chancery against
       her said Husband to have Part of the Estate so devised and bequeathed to her
       by her said Brother assigned for her seperate Use and Maintenance But
       Before the same was done they the said Hutchinson Parker and Alethea
       his Wife agreed that he the said Hutchinson Parker should convey one full
