176. of Indenture made or mentioned to be made between Daniel Carroll Merch.t of Prince Georges County of the one Part & Thomas Davis of Frederick County Innholder of the other part as by Reference being had to the Said Deed among the Land Records of the Provincial Court may more fully appear Together with all the Improvements thereupon being and also all the Right Title Interest and demand in and to all and singular and every the Premisses in the said Deed contained the Said Deed bearing equal Date with these Presents To have & To hold the same and every part thereof to the Said Daniel Dulany his Heirs and Assigns forever to and for his and their Proper Use and Behoof Provided always that in Case the Said Thomas Davis his heirs Executors or Administrators shall well and truly pay unto the Said Daniel Dulany his Executors or Administrators at or before the first of January next ensuing the Date of these presents the full and just sum of One hundred and Thirty Pounds thirteen Shillings and four pence Sterling together with legal Interest from the date of these Presents then this present Indenture & every Matter and Clause therein to be void and cease ^and that the Estate hereby Granted be Devested in the said Thomas Davis his Heirs and Assigns^ But in case that Default shall be made in the payment afd then and in such case it is the Intent & Meaning of the Parties to these Presents that it shall and may be Lawfull for the said Daniel Dulany or his Assigns to Expose the Same to sale when and at such Time or Times as He or they shall think proper & the money arising or that shall arise from such sale to apply to the payment of the Principal Money aforesaid and the legal Interest that shall at the Time of such sale became due thereupon (Ten days notice of such sale being first given) & in case there shall be any surplus after the application aforesaid that the said surplus be paid to the said Thomas Daviss his Executors Administrators or Assigns In Witness whereof the said Thomas Daviss hath hereunto affixed his Hand & deal the day and year abovesaid Tho.s Daviss s Sealed and Delivered The Words as the one Part between the first and second lines being first interlined in the presence of J Hepburn Daniel Carroll On |
