148. so Appointed and acting under the Said Commission being some time since dead) of the one part and John Caile of the Province of Maryland in America Gentleman and Elizabeth Caile of the same place Widow of the other Part Witnesseth that the Said John Younger and Gabriel Griffith for and in Consideration of the sum of Fifty pounds of Good and Lawfull Money of Great Brittain to them or the one of them in hand well and truly paid or secured to be paid by the said John Caile and Elizabeth Caile or the one of them at or before the sealing and delivery of these presents the receipt whereof they the Said John Younger and Gabriel Griffith do hereby Acknowledge and thereof and of every part thereof do acquit Exonerate and discharge the said John Caile and Elizabeth Caile and each and either of them their and each of their heirs Executors and Administrators and every of them by these presents Have and each and either of them Hath Bargained sold aliened released and Confirmed and by these Presents Do and each and either of them Doth bargain sell alien release and Confirm unto them the said John Caile and Elizabeth Caile (in their actual Possession now being by Virtue of a Bargain and sale to them thereof made for one whole Year by Indenture bearing date the day next before the day of the date of these Presents Executed before the Execution hereof and by force of the Statute for transferring of Uses into Possession) and to their heirs and Assigns All that Tract or parcell of Ground called and known by the Name of Berrys Point Situate lying and being in Dorchester County in the Province of Maryland aforesaid Beginning at a Bounded Beech heretofore marked on four sides with three Notches on each side standing by or near a Spring on the South Side of great Choptank River at a Place called or comonly Known by the Name of Fosters Point Opposite to the Mouth of a Creek called and Known by the Name of Tuckahoe Creek on great Choptank River aforesaid running from the Said Tree fifty Perches South and from thence One hundred and Sixty perches East from thence fifty Perches North and from thence with a streight line to the aforesaid Bounded Beech Containing in the whole Fifty Acres or thereabouts be the same more or less late the Estate of the sad Robert Gilpin the Bankrupt Together with all Houses Storehouses and Warehouses Lands Wastes Ways |
