12.

Exam.d   This Indenture made this Ninth day of May in the Year Seventeen
       hundred and Sixty three Between Charles Homewood of Ann Arundel County in the Province
       of Maryland Gentleman of the one part and John Ilesselius of the same County and Province Gentleman
       of the other part Whereas by Indenture of Mortgage duly Executed and Acknowledged and recorded in
       the provincial Court Land Records bearing date on or about the fourth day of October seventeen hundred
       and sixty made between the said Charles Homewood by the Name and Addition of Charles Homewood
       of Ann Arundel County Gentleman of the one part & a certain Henry Woodward (now deceased) by the
       Name and Addition of Henry Woodward of ann Arundel County Gentleman of the other part
       the said CHarles Homewood for the Consideration therein mentioned did grant Bargain and sell unto
       him the said Henry Woodward his Heirs and Assigns All those several Tract or parcels of land herein
       after particularly mentioned and premisses with the Appurtenances under a proviso or Condition
       (among many other Provisoes or Conditions in the Said Indenture Contained) Nevertheless
       to be void on the said Charles Homewood or such Wife as he should thereafter Mary or his Heirs
       Executors or Administrators or Trustees for such Heirs or any of them paying or causing to be paid
       to the said Henry Woodward his Executors Administrators or Assigns the sum of Money in the said
       proviso mentioned before at or after the fifth day of November seventeen hundred and seventy five
       And Whereas by another Indenture of Mortgage duly Executed and Acknowledged and recorded
       in the Provincial Land Records bearing date on or about the fourteenth day of March seventeen
       hundred and sixty one made between the afd Charles Homewood by the Name and Addition of CHarles
       Homewood of Ann Arundel County Gentleman of the one part and the afores.d Henry Woodward
       in his Life Time by the Name and Addition of Henry Woodward of Ann Arundel County
       Gentleman of the other part reciting the said first mentioned Indenture the said Charles Homewood
       for the Consideration therein mentioned did further Covenant to and with the said Henry Woodward
       his Heirs Executors Administrators and Assigns that the Consideration Money in the said first
       Mentioned Indenture Expressed should not be paid or tendered to be paid under the Condition
       or Proviso in the said first mentioned Indenture mentioned at any Time before the fifth  
       day of November which should be in the Year seventeen hundred and seventy one But
       that the said Henry Woodward his Heirs Executors Administrators and Assigns should
       and might peaceably and quietly possess and enjoy the said Mortgaged Premisses
       untill the said fifth day of November seventeen hundred and seventy one and so forth
       as in and by the said Indenture reference being there unto had may fully appear
