and the graves therein, belongirig to and connected with
said Church.

(b) To the bequest unto Morris A. Birely, of Thurmont,
Maryland, in trust nevertheless, the sum of Five Thousand
Dollars ($5,000.00) for the purpose of holding the same as
said Trustee and investing the same and re-investing the
same, and paying the net income arising therefrom annu-
ally unto the officers or trustees of the Lutheran and Re-
formed Churches at Rocky Ridge, in Frederick County,
Maryland, and said net income to be used by said Trustees
and their successors for the sole purpose of keeping in good
repair and condition the graveyard at Rocky Ridge, in Fred-
erick County, Maryland, which graveyard is now used
jointly as the graveyard by both Lutheran and Reformed
Church congregations at Rocky Ridge. In the event that a
corporation will at any time, now or hereafter, be formed
for the purpose of carrying on and maintaining the said
Cemetery at Thurmont, and also at Rocky Ridge, or at
either place, it is my desire and will and I do so hereby
direct that my said Trustee, Doctor Morris A. Birely, or his
successor as said Trustee, will pay over unto said corpora-
tion or corporations, now or hereafter formed for such pur-
pose, the corpus of said trust funds for the benefit of said
respective graveyards, upon the same trust and upon the
same terms, and upon the same conditions as held by said
Doctor Morris A. Birely as said Trustee and as above set
forth in this, my Last Will and Testament."

36. To the devise contained in the Will of Lucy S.
Schuette died leaving in the will among other provisions a
ground rent to the Evangelical Lutheran Church of the
Reformation, which is located in the 3rd Legislative District
and on the corner of Caroline and Lanvale Streets, Baltimore,
Maryland. This ground rent was created by a ninety-nine
(99) year lease from Lucy S. Schuette to Edward J. Cro-
ghan and wife, dated June 29, 1920, and recorded among the
Land Records of Baltimore City in Liber S. C. L. No, 3611,
folio 392. This rent is Thirty Dollars ($30.00) per annum
and is payable in semi-annual installments on the first day
of January and July by the said lessees who reside on the
premises. The Church derives title by virtue of the devise
to it of said rent by the Will of Lucy S. Schuette which is
on record in the office of the Register of Wills of Baltimore
City in Wills Liber J. H. B. No. 179, folio 147.

37. To the bequest contained in the Last Will and Testa-
ment of Henry A. Kahn, late of Frederick County, Mary-
land, said Will being recorded in Liber M. F. S. No. 1, folio
