                                       CHAP. CLXXXI.
A Further Additional Supplement to the act (a), entitled, An act to direct
                         Descents.

Tenants by the
courtesy.
    BE IT ENACTED, by the General Assembly of Maryland, That
whenever any person or persons are, or hereafter may be, entitled
as tenants by the courtesy to a life estate in an undivided part of
the real estate of an intestate, and the commissioners shall determine,
and so certify to the court in their return, that the said
estate cannot be divided without loss and injury to all parties concerned,
the chancellor, or the county court to which the said return
is made, shall proceed to award to such tenant or tenants such sum
in current money as he or they shall think just and equitable, in
lieu of such tenant by the courtesy; and in decreeing such value
to the said tenant, the chancellor, or the county court, (as the
case may be,) shall be directed by the age, health and condition,
of such tenant, and such award of value shall be sufficient to bar
such tenant from all and every right or title by such courtesy which
such tenant may claim to the lands and tenements of such intestate;
and the person making the election to take the estate at the valuation
of the commissioners, and under the award of the chancellor,
or county court, shall hold the said estate, disencumbered by any
tenancy by the courtesy.

                                          CHAP. CLXXXII.
An Act authorising a Lottery to raise a sum of money to purchase a
    Fire Engine in Cumberland, in Allegany County.

proposed—Bond
to be given.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That
George Thistle, Samuel Smith, John Scott, Jacob Lantz, John
Folk, Peter Loudermilk and William Lemar, sen. or a majority of
them, be and they are hereby authorised to propose a scheme or
schemes of a lottery for raising a sum of money not exceeding two
thousand dollars, and to sell and dispose of the tickets thereof,
provided by the said George Thistle, Samuel Smith, John Scott,
Jacob Lantz, John Folk, Peter Loudermilk and William Lemar,
sen. or a majority of them, before they proceed to the sale of any
ticket or tickets in said lottery, shall give bond to the state of
Maryland, in the penalty of four thousand dollars, conditioned that
they will well and truly apply the monies arising therefrom, within
twelve months after the drawing thereof, to the payment of the
prizes drawn therein, to the adventurers to whom they shall be
due, and after deducting the necessary expensed incurred in the
management thereof, shall apply the residue within twelve months,
to the purchase of a fire-engine in the said town.
Bond to be lodged
in clerk's office.
    2.  AND BE IT ENACTED, That the said bond shall be lodged in
the clerk's office in Allegany county, to be there recorded, and
upon such bond, or any office copy thereof, suit or suits may be instituted
for any breach or noncompliance with the condition
thereof.
