Dividing Creek the third tuesday of November then next to answer unto William Richards of a plea of trespass upon the Case and that thereof he Should not fail &.c Att which Said third tuesday of November to witt the Seventeenth day of the Same month anno Dom One thousand Seven hundred and thirty Ca being the day of the Return of the Said Writt Cometh the Said William Richards in his proper person and the Sher of Somerset County to whom the foregoeing writt was directed ^likewise^ Comes and makes return thereof to the Court here Endorsed in these words following viz.t Cepi Corpus P John Purnall sher And the Said Robert Adkins by Francis Allen and James Shirley his attorney Comes and defends the force and Injury when &.c and prays Leave thereof to Imparle here untill the next Court and he had it and the Same day is Given to the aforesaid plft here also Att which said next Court to witt the Sixteenth day of march anno Dom One thousand Seven hundred and thirty Came againe the Said Robert Adkins by his attorneys aforesaid and Offers himselfe against the aforesaid William Richards in the plea afd but the Said William altho' Solemnly Called Came not nor doth is his writt afd further prosecuted &c Therefore it is Considered that he and his pledges of prosecuting be in mercy and that the names of his Pledges be sought for and that the afd Robert Adkins Goe thereof without day and also it is Considered that the afd Robert Adkins Recover against the afd William Richards his damages by Occasion of the premisses 155 to One hundred & fifty five pounds ot tobacco by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the Statute &.c by the Court here adjudged &c
thousand seven hundred and thirty at Somerset County within the Jurisdiction of this court was Indebted unto the said Giddion in the sum of three pounds fifteen shillings and five pence currant money as by note therewithin court produced may apear and so thereof being Indebted the said John In Consideration thereof afterwards to witt the same day and year afd at the county aforesaid and within the aforesd Jur upon himself assumed and to the said Giddion then and there faithfully did promise that when afterwards he should be thereto requested he the afd sum of three pounds fifteen shill and five pence Curr money to the same Giddion would well and faithfully Content and pay Nevertheless the said John his promise and assumption aforesd in forme aforesaid made Little Regarding but plotting and fraudulently intending him the same Giddion in that part Craftilly and Subtilly to Defraud and Deceive he the said John the aforesd sum of three pounds fifteen shill.s and five pence Currant money Nor any part thereof to the same Giddion hath not paid or him for it in any wise contented altho' the said John afterwards to witt (the) |
