72 the same day and year aforesd at the County aforesd and within the afd Jur was thereto requested by the same Giddion but the said the same Giddion says he is worse to the Value of seven pounds Like money and thereof brings this Suit &c Levin Gale P Qued pledges of proses J Doe R Roe And the aforesaid John Burke in his Own proper person Comes and defends the force and Injury when &c & prays Leave thereof to Imparle hereunto untill the ^next^ Court and he hath it and the Same day is Given to the aforesaid plft here also &c Att which Said Next Court to witt the Sixteenth day of March ann Dom One thousand Seven hundred & thirty Came again the Said Giddion Tillman by his attorney afd & prays that the afd John Burke to his declaration afd may answer &.c but the Same John Burke Says nothing in bar or preclusion of the action aforesaid of the afd Giddion by which the Same Giddion Remaineth against the afd John thereof undefended &c Therefore it is Considered that the aforesaid Giddion Tilman Recover against the afd 252 John Burke his damages aforesaid to three pounds fifteen Shillings and five pence Currt mony as also two hundred & fifty two pounds of tobacco for his Costs and Charges to ye same Giddion by the Court hereof his assent adjudged and the afd John in mercy &c
smith deced of a plea of trespass upon the case &.c And Whereupon the said Robert by Francis Allen his Attorney complaines that whereas the said Jones the thirteth day of Octeber Ann Dom seventeen hundred and twenty Eight at somerset county aforesd within the Jur of this court was Indebted unto the said Archibald in fifteen pounds Nineteen Shill.s and two pence half penny curr.t money of maryland as by account hereunto annexed may in court appear and being so thereof Indebted the said Jones in consideration thereof the day and year aforesd at the place aforesd within the Jur aforesd upon himself did assume and to the said Archibald then and there did faithfully promisse that he the said Jones the said fifteen pounds Nineteen Shillings and two pence half penny to the said Archibald when he should should be thereunto requested he would well and faithfully pay and content and altho' the said Jones tenn pounds tenn shillings and one penny half penny pcell of the aforesd fifteen pounds Nineteen Shillings and two pence half penny to the said Archibald in his life time he hath paid and satisfied yet as to Five pounds Nine Shillings and one penny residue of the aforesd fifteen pounds Nineteen Shillings and two pence half penny the said Jones his promise and assumption aforesd in forme aforesd made Nothing regarding But plotting and fraudulently Intending the said Archibald in his Life time and the said Robert since the decease of the said Archibald in that part Craftilly and Subtilly to deceive and Defraud the said five pound Nine Shillings and one penny to the said Archibald in his Life time or to the aforesd Robert in his capacity afd since the decease of the said Archibald hath not paid or contented (nor) |
