305 and assigns two thirds of all the crop of corn raised this year on said farm consisting in all of about one hundred barrels and two thirds of all the crop of oats consisting of about one hundred bushels raised this year on said farm one gray horse one bay horse 2 milch cows and two calves the property of said Thomas Sherbert now on said farm together with all the ploughs and other implements of husbandry on said farm. And the said Jane Sherbert doth hereby grant bargain and sell unto the said Wirt as agent as aforesaid his executors administrators and assigns one old yoke of black & red oxen and cart two milch cows one of them white and the other spotted to calves and one other yoke of young oxen the property of said Jane Sherbert now on said farm. To Have and to Hold all and singular the above described personal property and effects hereby granted bargained and sold or intended so to be unto him the said Dabney C. Wirt agent as aforesaid his executors administrators and assigns forever in Trust nevertheless that the said Wirt his executors administrators or assigns shall and may at any time in his discretion with the amount of the said Thomas and Jane respectively sell any of the aforesaid property at private sale and if money more be not realized by such private sales for the purposes hereinafter mentioned before the twenty fifth day of November eighteen hundred and forty eight then that the said Wirt agent as aforesaid his executors administrators or assigns may and shall after having given ten days previous notice thereof by hand bills to be distributed through the neighborhood of said farm proceed to sell the above described personal property and effects or so much thereof as may be necessary on or about the twenty fifth day of November eighteen hundred and forty eight in a credit as may seem best to said Wirt the extent of the credit and sufficiency of the security to be left to the said Wirt and apply the proceeds of said sales to the payment of the expenses of this trust and of said sale and to the payment to the said Wirt as agent as aforesaid of the aforesaid sum of one hundred and eighty nine dollars and the interest that may be due thereon and in further trust to transfer to the said Thomas Sherbert and Jane Sherbert so much of their aforesaid property respectively if any as may remain after said sales and appropriation of the proceeds as aforesaid And the said Wirt is hereby improved and authorised to make other sales of said property at such times as he may appoint for the purposes aforesaid in case the proceeds of the first public sale be insufficient for the payments as aforesaid. And they the said Thomas Sherbert and Jane Sherbert such for themselves respectively and their respective executors administrators and assigns do hereby covenant promise and agree to and with the said Wirt agent as aforesaid his executors administrators and assigns that they will have their aforesaid property respectively prepared and ready in said farm and that the said Thomas Sherbert will have the sid corn and oats gathered and prepared and ready on said farm in good order to be delivered to the purchasers thereof on the day of sale herein before appropriated and provided for In Witness whereof the said Thomas Sherbert and Jane Sherbert |
