306 have hereunto set their hands and seals the day and year first hereinbefore written Signed sealed & delivered in the his presence of J W Hunter Thomas x Sherbert (seal) mark her Jane x Sherbert (seal) mark Anne Arundel County sc.t Be it remembered that on this twenty ninth day of September in the year eighteen hundred and forty eight before the subscriber a Justice of the peace of the State of Maryland in and for Anne Arundel County personally appeared Thomas Sherbert and Jane Sherbert parties grantor in the aforegoing instrument of writing and acknowledged the same to be their respective at and deed for the purposes therein mentioned: And I do hereby certify that I am satisfied by oral testimony under oath received by me that Thomas Sherbert and Jane Sherbert the persons making this acknowledgment are the persons named and described as and professing to be the parties grantors in the aforegoing deed or instrument of writing At the same time of the above acknowledgment the said Dabney C Wirt grantee on the above deed of trust makes oath before me that the consideration set forth in said deed of trust is true and bona fide as therein set forth Acknowledged before certified by and sworn before J W Hunter Recorded on the 6.th day of October 1848 Cost $2.00 paid
said Franklin Carrick in the sum of three hundred dollars current money and to secure the payment thereof is willing to execute these presents. Now this Indenture witnesseth that the said Benjamin Carrick for and in consideration of the premises and of the sum of five dollars current money to him in hand paid by the said Franklin Carrick at or before the sealing and delivery of these presents doth grant bargain and sell by these presents and hath granted bargained and sold unto the said Franklin Carrick the entire crop of corn now growing upon the land supposed to b about one hundred barrels one bay horse on black mare one pair of oxen and ox cart three cows twelve sheep and household and kitchen furniture unto the said Franklin Carrick his executors administrators and assigns to his own proper use and behoof. Provided always and it is declared to be the true intent and meaning of these presents that if the said Benjamin Carrick do and shall well and truly pay or cause to be paid to the said Franklin Carrick his executors administrators and assigns the said sum of three hundred dollars with legal interest for the same on or before the first day of January in the year eighteen hundred and forty nine then and in that case these presents and every matter and thing herein contained shall cease and be void anything herein contained to the contrary notwithstanding and the said Benjamin Carrick for himself his heirs executors administrators |
