308 I the said Thomas Chaney do hereby acknowledge have granted bargained and sold and by these presents do grant bargain and sell unto the said James Chaney his Executors administrators and assigns one Gray mare about seven years old two beds and their furniture two bedsteds one clock half dozen chairs two tables all of my crockery ware also all monies that may be due me at this time both at Law and in equity or which may be due me hereafter all which property is now in my possession To have and To hold the same described property to the said James Chaney his Executors administrators & assigns forever and I the said Thomas Chaney for myself my heirs Executors and administrators the aforesaid described property to the said James Chaney his Executors administrators and assigns against me the said Thomas Chaney and against my Executors and administrators and against all and every other persons whomsoever shall and will warrant & forever defend by these presents Provided nevertheless in case I the said Thomas Chaney shall pay and satisfy to the said James Chaney or to his Executors administrators or assigns the aforesaid sum of one hundred and sixty dollars Current money with Interest for the same on or before the Eighth day of January in the year of our Lord Eighteen hundred and forty seven then this bill of sale and every matter & thing therein expressed shall be void and of none effect it being the true intent and meaning thereof until the said described property is mortgaged by me to the said James Chaney to secure the payment of the money aforesaid In Witness whereof I the said Thomas Chaney have hereunto set my hand and affixed my seal this 8th day of January Eighteen hundred and forty four Signed Sealed and delivered in Thomas Chaney (seal) presence of Jo.s Nicholson At the foot of the aforegoing was thus written to wit Maryland Anne Arundel County to wit: On this 8th day of January 1844 before me one of the Justices of the peace for the County & State aforesaid appears Thomas Chaney and acknowledges the foregoing instrument of writing to be his act and deed according to the true intent and meaning thereof and the Act of Assembly in such case made & provided And I further Certify that the said Thomas Chaney is personally known to me to be the same Identical person professing to have signed & sealed the same Witness my hand chd Jo.s Nicholson 5½ Recorded the 20 day of January 1844 |
