302 executed mortgage having the whole amount of said Mortgage due and unpaid And whereas the said Orlando Hancock in consideration of the sum of one hundred and sixty three dollars and twenty Cents hath agreed to assign the said mortgage to the said Thomas J Mezick without recourse to the said Orlando Hancock in case the said Thomas J Mezick should fail to receive the amount of said Mortgage Now this Indenture Witnesseth that the said Orlando Hancock in consideration of the sum of one hundred and sixty three dollars and twenty Cents to him in hand paid by the said Thomas J Mezick before the sealing and delivery hereof hath granted bargained sold and to me paid and by these presents doth grant bargain sell transfer assign and make over to the said to the said Thomas J Mezick the said negro boy Robert Stepney for the period of service mentioned in said Mortgage To have and To hold the same to him the said Thomas J Mezick his heirs and assigns as fully and in as ample a manner as the said Orlando Hancock his heirs or assigns might hold and enjoy the same by virtue of the Mortgage deed aforesaid and not otherwise And the said Orlando Hancock doth for himself his heirs Executors and administrators hereby authorize and empower the said Thomas J Mezick his heirs Executors and administrators to receive to his and their own use and benefit the sum or sums of money mentioned in the Condition of said deed whenever the same shall be tendered and paid to him or them by the Mortgagor his heirs Executors or administrators agreeably thereto and to disharge the said Mortgage or to reconvey the said Negro boy upon his redemption as fully and to all intents and purposes as the said Orlando Hancock might or could have reconveyed or discharged the same in use of such payment or redemption in ^case^ this assignment had not been made In Witness whereof the said Orlando Hancock hath hereto set his hand and affixed his seal the day and year first herein before written Signed Sealed & delivered in presence Orlando Hancock (seal) of J W Hunter At the foot of the aforegoing was thus written to wit Received this Eleventh day of December 1843 of Thomas J Mezick One hundred and sixty three dollars and twenty Cents the consideration money of the foregoing assignment Orlando Hancock Witness J W Hunter Maryland Anne Arundel County sc Be it remembered That on this Eleventh day of December 1843 personally appeared before me the subscriber a Justice of the peace of the State of maryland for Anne Arundel County the above named Orlando Hancock whom I Certify of my own knowledge to be the Identical person named as grantor in the foregoing deed of assignment and (acknow) |
