189 act of assembly in such case made and provided Witness my hand and done before chd Lewis Sutton S.r 63 5 Recorded the 26th day of July 1842 This Indenture made this 23 third day of July 1842 between Ephraim W Hall of the one part and Margret Hall of A A County of the other part wareas the said E W Hall owes and stands Justly indebted to the said Margret Hall in the sum of $2000 Current money and to secure the payment thereof is willing to Execute these presents Now this Indenture Witnesseth that the said E W Hall for and in consideration of the premises and for and in consideration of the sum of five dollars Current money to him in hand paid by the said Margret Hall at or before the sealing and delivery of these presents the receipt whereof the said E W Hall doth hereby acknowledge and therefore and therefrom doth acquit release exonerate and forever discharge the said Margret Hall her heirs executors and administrators and every of them by these presents hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Margret Hall her Executors administrators and assigns all and singular the goods and furniture and household stuff herein after mentioned that is to say one stack wheat one Lot of oats in the straw one horse cart one Lot of wood consisting of Pine & oake the crop of corn Potatoes & Tobacco now growing in field one note of $570 46 head by said E W Hall or Richard I Jones To have and To hold all and singular the said property herein before granted bargained and sold or mentioned or intended so to be unto the said Margret Hall her Executors administrators and assign to the only proper use and behoof of the said Margret Hall her executors administrators and assigns forever Provided always and these presents are upon this Condition that if the said E W Hall his executors or administrators shall and do well and truly pay or cause to be paid unto the said Margaret Hall her Executors administrators or assigns the full sum of $2000 Current money with Legal Interest for the same then and in such case these presents and every matter and thing herein Contained shall cease determine and be utterly void to all intents and purposes anything to the Contrary thereof in any wise Notwithstanding and the said E W Hall for himself his executors and administrators all and singular the said property by these presents granted bargained and sold and every part thereof unto the said Margret Hall her Executors and administrators and assigns against him the said E W Hall his Executors and administrators and against all and every other person and persons whatsoever shall and will warrent and forever defend by these presents and the said Margret Hall for herself her heirs executors and administrators doth Coventant promis grant and agree to and with the said E W Hall his Executors and administrators that the said Margret Hall her Executors and administrators or assigns shall and will immediately upon the receipt of the sum of $2000 and in trust as aforesaid unto the said E W Hall his Executors administrators or assigns |
