PARRIS N. GLENDENING, Governor                          H.B. 1004

certain employees serve at the pleasure of the Sheriff; providing that prohibiting
certain employees may not be from being reduced below a certain rank without just
cause; making a stylistic change; and generally relating to employee rights for
employees of the Harford County Sheriff's Office.

BY repealing and reenacting, with amendments,
Article - Courts and Judicial Proceedings
Section 2-309(n)
Annotated Code of Maryland
(1989 Replacement Volume and 1994 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Courts and Judicial Proceedings

2-309.

(n) (1) The Sheriff of Harford County shall not have employment outside of
that position, and shall receive a salary of:

(i)     $52,000 in 1991;

(ii)    $55,000 in 1992;

(iii)   $58,000 in 1993; and

(iv)    $60,000 in 1994 and thereafter.

(2) [He] THE SHERIFF shall appoint the number of deputies at the
compensation provided in the county budget.

[(2)] (3) The Sheriff may appoint as a special deputy sheriff:

(i) The chief of police of a Harford County municipality; or

(ii) A member of the police force of a Harford County municipality
who is certified by the Maryland Police Training Commission.

[(3)] (4) A special deputy sheriff appointed under this subsection is not an
employee of THE SHERIFF OR OF Harford County.

(5) (I) IN THIS PARAGRAPH, "JUST CAUSE" MEANS A GOOD FAITH,
REASONABLE BASIS FOR DISSATISFACTION WITH THE JOB PERFORMANCE OF AN
EMPLOYEE.

(II) (I) EXCEPT AS PROVIDED IN SUBPARAGRAPH (III) (II) OF
THIS PARAGRAPH, AN EMPLOYEE OF THE HARFORD COUNTY SHERIFF'S OFFICE
MAY NOT BE TERMINATED WITHOUT JUST CAUSE.

(III) (II) SUBPARAGRAPH (II) (I) OF THIS PARAGRAPH DOES NOT
APPLY TO:

1. THE CHIEF DEPUTY;
