411 Sworn before me the day and year aforesaid Charles Corkran Received the fifth day of April 1852 of Caleb Shepherd the sum of one dollar in lieu of a stamp on this deed Francis J Henry Clerk James Higgins Be it remembered and it is hereby certified that the following Mortgage Exd from 65 Bill of sale was received and recorded on the 23.rd day of April 1852 to wit Nancy Camper Negro This indenture made this 8.th day of April in the year of our Lord 1852 between Nancy Camper of the one part and James Higgins of the other part both of Dorchester County in the state of Maryland whereas on the fifth day of March 1852 the said Nancy Camper was arrested and taken before James Mobray a Justice of the peace in and for said County and state aforesaid charged with feloniously stealing and carrying away four Geese the property of Geo Merideth of said county and whereas the said James Higgins and then and there after bail in the penal sum of fifty dollars for the appearance of the said Nancy Camper at the first term of the circuit court for said County to be held next ensuing the date of these presents And whereas the said Nancy Camper being desirous and wishing to save harmless and free from loss the said James Higgins by reason of his having so entered her bail is willing to execute these presents Now this indenture witnesseth that the said Nancy Camper for and in consideration of the premises and of the sum of one dollar Current money to her in hand paid by the said James Higgins at and before the sealing and delivery of these presents the receipt of which is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto the said James Higgins his executors administrators and assigns all and singular the cattle hogs ^and^ household stuff hereinafter particularly mentioned and expressed that is to say one pied Cow and calf one red and dark Cow One Brindle heifer one Bull and one Bull yearling Eight head of hogs two geese one turkey one Bed and Bedstead one pine safe one table one Oven and lid three iron pots and three pair of pot Hooks one tea kettle and all the balance of my household furniture to have and to hold all and singular the cattle hogs and household furniture or stuff unto the said James Higgins his executors administrators and assigns to his and their own use and behoof Provided always and it is declared to be the true intent and meaning of these presents that if the said Nancy Camper shall make her personal appearance at the first term of the Circuit Court for said County to be held next ensuing the date of these presents then and there to answer such charges as may be alleged against her for and concerning the feloniously stealing and carrying away the geese aforesaid and to do and receive what shall by the court be then and there enjoined her and shall not depart from the said Court without license there and in such case these presents and every matter and thing herein contained shall cease determine and be utterly void otherwise to remain in full force and virtue in law But in default of the said Nancy Camper appearing at the said Court as aforesaid at the time aforesaid then these presents or upon their further Trusts and it is hereby agreed that Delivered to Jas Higgins May 25th 1858. |
