household stuff implements and personal property hereby conveyed for
money or upon credit as he ot they shall deem advisable and the sum or
sums so realized to apply and dispose of in the following manner in
the first place to pay and return to and reimburse him or themselves
all costs charges and expenses as he or they shall or may pay sustain
or expend in or about such sale or sales so to be made as aforesaid
and do and shall thereout also pay the expenses of preparing and executing
these presents and all other costs charges and expenses incident to or which
may be incurred in and about the execution of the trusts herein expressed and
to retain thereout the sum of ten per cent upon all such sum or
sums as may be realized by such sale or sales for his or their labor
and diligence in executing and discharging the Trusts herein expressed
and then in trust to apply any balance or balances to the payment
and discharge in full of all and every such execution or executions as
are now in lieu upon any of secured property right or credits hereby
Conveyed and then in trust to pay or indemnify all persons who
have entered into signed or executed any Bond or become Security
for the sad Thomas H. Hurley within individually or as executor
administrator Trustee or Guardian and the claim or claims severally
for which they or any of them are or shall become liable as such security
or securities whether on bond note or as supersidious on any judgment
and those in trust for any or all other Creditors of him the said Thomas
H. Hurley to be paid to them equally and proportionably without any
preference in priority of payment if any balance should be left after
Justly paying and discharging the said expenses, Costs, and labor, of
the said Caleb Shepherd and truly paying and discharging the said
executors and security debts, it being the intention that the same shall
be preferred in and by this indenture.   In witness whereof the said party
of the first part hath hereunto set his hand and seal the day and year first
above within signed sealed and delivered in presence of Lines 5 6 7 and 8 on 3rd page
erased before execution and the word "negroes" throughout
the Instrument erased before execution

State of Maryland Dorchester County   Be it remembered and
it is hereby certified that on this fifth day of April 1852 before the subscriber
a Justice of the peace in and for the County and State aforesaid personally
appeared Thomas H. Hurley grantor and acknowledged the above instrument
of writing to be his act and deed according to the purport true intent and
meaning of the same, and at the same time came before me Caleb Shepherd
party grantee named in the said Bill of sale or assignment and made oath
on the Holy Evangely of Almighty God that the Consideration set forth in
the said Bill of Sale is true and bona fide, as therein set forth according
to the act of assembly in such case made and provided  Acknowledged and
