405 Know all men by these presents That I Samuel Burns of Dorchester County and State of Maryland for and in consideration of the sum of two hundred and fifty one dollars and thirty one cents lawful money of the united States in hand paid by John S Staplefort at the same place at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged Have granted bargained and sold and by these presents do grant bargain and sell unto the said John S Staplefort his Executors Administrators and Assigns my negro woman Eliza aged about twenty four years and her son Jim aged about 8 years both of Brown colour and slaves for life to have and to hold the said described negroes Eliza and Jim to the said John S Stapelfort his Executors administrators and assigns and I the said Samuel Burns for myself my heirs Executors and Administrators the Said Negroes Eliza and Jim unto the Said John S Stapelfort his executors administrators and assigns against me the Said Samuel Burns my executors and administrators and against all and every other person or persons whatsoever shall and will warrant and forever defend by these presents provided nevertheless and it is ^the^ true intent and meaning of these presents and of the said parties hereto that in case I the said Samuel Burns my executors or administrators shall well and truly pay and satisfy to the said John S Staplefort his executors administrators or assigns the said sum of Two hundred and fifty one dollars and thirty one cents lawful money aforesaid with interest for the same on or before the thirteenth day of March 1853 then this Bill of Sale and every matter and thing herein expressed shall be null and void it being the true intent and meaning thereof that the said negroes Eliza and Jim is mortgagees by me to the said John S Stapelfort his executors Administrators or assigns the payment of the said sum of $251.31 In witness whereof I have hereunto set my hand and seal this 13.th day of March ^Eighteen hundred and fifty two^ 1852 Signed Sealed and delivered in the presence of Samuel Burns (Seal) A. H. Pennington City of Baltimore S S. Be it remembered that on this 13.th day of March 1852 before the subscriber a justice of the peace for said city appears Samuel Burns grantor and mortgagor and acknowledges the above Instrument of writing to be his act and deed according to the true intent and meaning thereof also appeared John S Stapelfort party grantee and mortgagor named in the above Mortgage Bill of sale and made oath on the holy Evangely of almighty God that the consideration therein named is bona fide true as is herein set forth acknowledged and sworn before A. H. Pennington J. P. State of Maryland Baltimore City Sct I hereby certify that A. H. Pennington Esquire before whom the annexed acknowledgment and affidavit was made and who has thereto subscribed his name was at the time of so doing a Justice of the peace of the state of Maryland in and for the city of Baltimore |
