40. that he the said William Davidson, his Executors, Administrators or assigns shall and will immediately upon the receipt of the said sum of six hundred dollars and interest as aforesaid at the day and time limited for payment thereof deliver or cause to be delivered unto the said James W. Davidson, his Executors, Administrators or Assigns all and singular the above described property which are now at the time of executing these presents received by the said William Davidson from the said James W. Davidson in good plight and condition as the same or any of them now at this present time, death, natural decay, or other unavoidable circumstances executed. In testimony whereof the said James W. Davidson has hereunto set his hand and seal on the day & year first within written. his Signed, sealed & delivered in the presence of James W. x Davidson (Seal) John B. Leckie Martin M. Dean mark State of Maryland Dorchester County, To wit: Be it remembered and it is hereby certified that on this 13.th day of December A. D. 1847 before the subscriber a Justice of the Peace of the State of Maryland in & for Dorchester County aforesaid personally appeared James W. Davidson he being known to me to be the person who is named and described as and professing to be the party to the foregoing Indenture and doth Acknowledge the said Indenture or instrument of writing to be his act and deed. In testimony whereof I hereunto subscribed my name on the day and year aforesaid. John B. Leckie State of Maryland Dorchester County, To wit: On this 13.th day of december A. D. 1847 before me the subscriber a Justice of the Peace of the state of Maryland in and for Dorchester County aforesaid personally appeared William Davidson, Mortgagee of the within Mortgage at the time of the Acknowledgment of said Mortgage and made Oath on the Holy Evangely of Almighty God that the consideration set forth in such deed of Morgage is true and bona fide as therein set forth. Sworn before John B. Leckie James D. Twelley Be it remembered that the following Bill of Sale from Ex.d was recorded on the 16.th day of December 1847, To wit: Emily L. Hurst & Maryland sct. Know all men by these presents that Elijah Hurst Emily Hurst wife of Elijah Hurst hath (with the consent of her said Husband testified by his signing & Acknowledging the Bill of sale) for and in consideration of the sum of one hundred and seventy five dollars to her in hand paid by James D. Twelley, have granted, bargained and sold and by these presents do grant, bargain and sell unto the said James D. Twelley delivered to James D Twelley June 4.th 1852 |
