39. his Executors, Administrators and Assigns all and singular the following property hereafter particularly mentioned and expressed that is to say one Negro Man named Henry between twenty one and twenty three years old also one brown Horse, one grey Horse, two Cows, three yearlings also one Bed, Bedstead & furniture also Ploughs & Harrows. To have and to hold all and singular the said Negro Man Henry, Horses, Cows, yearlings, Bed, Bedstead & furniture unto the said William Davidson, his Executors, Administrators and Assigns to his and their own use and behoof: Provided Always and it is declared to be the true intent and meaning of these presents that if the said James W. Davidson do and shall well and truly or cause to be paid unto the said William Davidson, his Executors, Administrators or Assigns the full sum of six hundred Dollars current money with legal interest for the same on or before the 13.th day of December in the year 1852 then and in such case these presents and every matter and thing herein contained shall cease, determine and be utterly void to all intents and purposes any thing herein contained to the contrary notwithstanding: And that he the said James W. Davidson, his heirs, Executors or Administrators shall and will well and truly pay or cause to be paid unto the said William Davidson, his Executors, Administrators or Assigns the sum of Six hundred dollars current money together with the interest for the same after the rate aforesaid at such times and after such manner and herein before set forth & agreed for the payment thereof: And also that if default shall be made in the payment of the said sum of Six hundred Dollars current money and interest or any part thereof at the times or in the manner aforesaid then and from thenceforth it shall and may be lawful to and for the said William Davidson his heirs & assigns to have and to hold the said Negro Man named Henry as above bargained and sold or intended so to be during his natural life or forever together with the Horses, Cows, yearlings, Bed, Bedstead & furniture Ploughs and Harrows and every part thereof to and for the use and benefit of the said William Davidson, his heirs and Assigns forever And the said James W. Davidson, his Executors and Administrators all and singular the aforesaid Named Negro, Horses, Cows, yearlings, Bed, Bedstead and furniture &c by these presents granted, bargained & sold and every part thereof unto the said William Davidson, his Executors and Administrators and Assigns against him the said James W. Davidson, his Executors and Administrators and against all and every person and persons whatsoever shall and will warrant and defend by these presents. And the said William Davidson for himself, his heirs, executors and administrators doth covenant, promise, grant & agree to and with the said James W. Davidson, his Executors & administrators |
