368. Assigns, to his and their own use & behoof: Provided Always, and it is declared to be the true intent & meaning of these presents, that if the said Joseph T. Vane do and shall well and truly pay, or cause to be paid unto the said Horatio G. Grieves, his Executors, administrators or assigns, the full sum of one hundred and fifty eight dollars & sixty eight cents, current money, with legal interest for the same, on or before the first day of January one thousand eight hundred & fifty three, then & in such case, presents and every matter & thing therein contained shall cease, determine and be utterly void, to all intents and purposes, any thing herein contained to the contrary notwithstanding. And the said Joseph T. Vane hereby covenants and agrees with the said Horatio G. Grieves, that he the said Joseph T. Vane, his heirs, Executors or Administrators, shall and will well & truly pay, or cause to be paid, unto the said Horatio G. Grieves, his Executors, Administrators or Assigns the said sum of one hundred & fifty eight dollars & sixty eight cents, current money, together with interest for the same after the rate aforesaid, at such time and after such manner as herein before set forth & agreed, for the payment thereof. In testimony whereof I have hereunto subscribed my hand and affixed my seal the day & year first above written. James Rea. Joseph T. Vane (Seal) State of Maryland, Dorchester County, ss. Be it remembered & it is hereby Certified that on this fifth day of November, A. D. 1851, before the subscriber one of the Justices of the Peace of the State of Maryland for the County aforesaid, personally appears Joseph T. Vane, he being the person who is named & described as, and professing to be the a party to the foregoing Bill of sale or Indenture, or instrument of writing, and doth acknowledge the said instrument of writing to be his act & deed: And at the same time & place also appeared before the subscriber, Horatio G. Grieves, the Grantee in the said Bill of sale named, and made Oath on the Holy Evangely of Almighty God that the consideration set forth in the said Bill of sale is true and bona fide as therein set forth. Sworn to and Acknowledged before James Rea Received the 5.th November 1851 the sum of Ten Cents in lieu of a stamp on this Mortgage Bill of sale. Wm Jackson Clk |
