160 Ann M Byns Be it remembered that the following Mortgage Bill of Sale was recorded Ex.d from 80 On the 28th day of February 1849 To wit William Stanley Byns and wife This Indenture made this 11th day of February 1849 between William S. Byns and Valeria V Byns his wife in the State of Maryland of the one part and Ann M Byns of Dorchester County and State aforesaid of the other part whereas the said William S Byns Mortgagor by his bond or obligation duly executed bearing date this first day of February 1849 stands bound unto the said Ann M Byns her executors admors or assigns in the sum of three hundred Dollars Current Money with a condition thereupon written for the payment of three hundred dollars Current money with legal interest for the same on or before the first day of February 1851 as by said bond and conditions may more fully appear. Now this Indenture witnesseth that the said Wm S. Byns Valeria V Byns in consideration of the sum of three hundred Dollars owing to the said Ann M Byns as aforesaid and for the better securing the Payment thereof with interest to the said Ann M Byns her executors Administrators or Assigns according to the Conditions of the said Bond and also in Consideration of the further sum of three hundred Dollars Current Money to him in hand paid at and before the sealing and delivery of these presents the Receipt whereof is hereby acknowledged by the said William S Byns and Valeria V Byns his wife hath granted bargained and sold and the said William S Byns and Valeria V Byns hath granted bargained and sold released and Confirmed and by these presents grant bargain and sell release and and Confirm unto the said Ann M Byns her heirs and Assigns all those right title claim & interest unto the negroes namely Dennis & Nace. To Have and To Hold the said boys To Have and To Hold the said Negroes Dennis & Nace for whole use & benefit and it is the true intent and meaning of these presents and of the said parties hereunto that if the said William S Byns & Valeria V. Byns their heirs Executors or administrators do and shall well and truly pay or satisfy or cause to be paid unto the said Ann M. Byns her executors administrators or assigns the said full sum of three Hundred dollars current money with legal interest for the same on or before the first day of February 1851 without any deduction or abatement whatsoever then and from thence forth these presents and every matter and thing therein contained shall cease and be utterly null and void any thing therein to the Contrary thereof in any wise notwithstanding. On the 11 day of Feby Eighteen Hundred & forty nine personally appeared before me a Justice of the Peace in and for said County William S. Byns & Veleana Byns and acknowledge the within and foregoing mortgage bill of sale to be their act and deed according to the purport true intent and meaning of the same and the acts of assembly in Such Cases made and provided and at the same time came before the subscriber a Justice of the peace as aforesaid Ann M. Byns the mortgagee within named and made Oath on the Holy Evangely of Almighty God that the consideration set forth in this Mortgage Bill of sale is true and bonafide as therein set forth acknowledge before me the subscriber a Justice of the Peace Sworn before Charles Corkran 1849 February 28 Rec.d of Ann M.
