375. Thomas K. Smith Be it remembered that the following Ex.d from Mortgage Bill of Sale was recorded on Foster Sewers the 10.th day of August 1846 This Indenture made this twentieth day of July in the year of Our Lord one thousand Eight hundred and forty six between Foster Sewers of Dorchester County in the State of Maryland of the one part and Thomas K. Smith of the City of Baltimore in the State aforesaid of the other part Whereas the said Foster Sewers owes and stands justly indebted to the said Thomas K. Smith in the sum of Forty dollars current Money and to secure the payment thereof is willing to execute these presents Now this Indenture Witnesseth that the said Foster Sewers for and in consideration of the premises and of the same of two dollars current money to him in hand paid by William Willoughby Agent for the said Thomas K. Smith at and before the sealing & delivery of these presents the receipt of which is hereby acknowledge, hath granted, bargained and sold and by these presents doth grant, bargain and sell unto the said Thomas K. Smith, his Executors, administrators and assigns all and singular the goods, stock, Farming Utensils and house hold stuff hereinafter particularly mentioned and expressed that is to say one Grey Horse, Ten head of Hogs, one Horse Cart and gear, two Beds and furniture, one Walnut Table and one Pine Table, six chairs, one Cupboard and one desk To have and to hold all and singular the said goods, stock, Farming Utensils and House hold stuff unto the said Thomas K. Smith, his Executors, Administrators and Assigns to his & their own use and behoof Provided Always and it is declared to be the true intent and meaning of these presents that if the said Foster Sewers do and shall well and truly pay or cause to be paid unto the said Thomas K. Smith, his Executors, Administrators or Assigns the fill and just sum of Forty dollars current money with legal interest for the same on or before the twentieth day of July in the year of Our Lord one thousand eight hundred and forty seven then in such case these presents and every matter and thing herein contained shall cease, determine and be utterly void to all intents and purposes any thing therein contained to the contrary notwithstanding And the said Foster Sewers for himself doth covenant, promise and agree to and with the said Thomas K. Smith, his heirs, executors and administrators shall & will well and truly pay or cause to be paid unto the said Thomas K. Smith, his executors, administrators or Assigns the said sum of Deld Thos B Smith 23 Decr 1847 |
