21 the said Thomas Smoot my executors and administrators and against all and every person or persons whomsoever shall and will warrant and forever defend by these presents Provided nevertheless that in case I the said Thomas Smoot shall pay and satisfy to the said Nathaniel Hearn or to his executors administrators or assigns the sum of six hundred dollars current money with interest for and on the same on or before the first day of January anno domini one thousand eight hundred and forty four then this bill of sale and every matter and thing therein expressed shall be void and of none effect it being the true intent and meaning thereof that the said by Mare sorrel horse two yoke of oxen three cows one ox cart one timber cart fifty barrels of corn eight stacks of fodder four beds and furniture two mahogany tables one side board six chairs and one cupboard are mortgaged by me the said Thomas Smoot for the payment of the money aforesaid In witness whereof I the said Thomas Smoot have hereunto set my hand and affixed my seal this twenty ninth day of December anno domini one thousand eight hundred and forty two Signed sealed and delivered Thomas Smoot (seal) in the pressence of Eben H Mason Thomas H Smoot Dorchester county State of Maryland On the second day of January anno domini one thousand eight hundred and forty three before the subscriber a Justice of the peace in and for the county and state aforesaid personally appeared Thomas Smoot and acknowledged the within and aforegoing bill of sale to be his act and deed according to the true intent and meaning thereof and the act of assembly in such case made and provided Witness my hand Geo.r A T Smith J.P.
