22 said Thomas Smoot acknowledge have granted bargained and sold and by these presents do grant bargain and sell unto the said Joseph Smoot his executors administrators and assigns two negro men slaves for life one names Risden aged about twenty three years one names Phill aged about twenty one years to have and to hold the said negro men slaves Risden and Phill to the said Joseph Smoot his executors administrators and assigns forever; and the said Thomas Smoot for myself my heirs executors and administrators the aforesaid negro men slaves Risden and Phill to the said Joseph Smoot his executors administrators and assigns against me the said Thomas Smoot my executors and administrators and and against all and every person and persons whomsoever shall and will warrant and forever defend by these presents Provided nevertheless that in case I the said Thomas Smoot shall pay and satisfy to the said Joseph Smoot or to his executors and administrators or assigns the sum of nine hundred dollars current money with interest for the same on or before the first day of January anno domini one thousand eight hundred and forty five then this bill of sale and every matter and thing therein expressed shall be void and of none effect it being the true intent and meaning thereof that the two aforesaid negro men slaves Risden and Phill are mortgaged by me the said Thomas Smoot to secure to the said Joseph Smoot the payment of the money aforesaid In witness whereof I the said Thomas Smoot have hereunto set my hand and affixed my seal this twenty seventh day of December anno domini one thousand eight hundred and forty two signed sealed and delivered in the pressence of Eben H Mason Thomas Smoot (seal) Thomas H Smoot Dorchester County state of maryland Sc On this second day of January anno domini one thousand eight hundred and forty three before the subscriber a Justice of the peace in and for the county and state aforesaid personally appeared Thomas Smoot and acknowledge the within bill of sale to be his act and deed according to the true intent and meaning thereof and the act of assembly in such case made and provided Witness my hand Geo.r A R Smith JP |
