200. executors, administrators and assigns one Bay Mare fourteen years old, one Yoke of work Stears, two young Stears, three milch Cows, eight head of Sheep, two sows and pigs three beds and furniture three Chests, one Table, one Ox Cart and one Still, all which property is now in my possession To have and to hold the same described property above bargained and sold to the said Lufkin Hurlock his executors, administrators and assigns forever to his and their only proper use and benifit and I the said James Wheatley for myself my executors and administrators shall and will warrant and forever defend by these presents to the said Lufkin Hurlock his executors, administrators and assigns the said described property against me my whomsoever claiming the same or any part thereof. In testimony whereof I have hereunto set my hand and affixed my seal this seventh day of February in the year of eighteen hundred and forty four signed, sealed & delivered his in the presence of James x Wheatley (seale) Geo A. Z. Smith mark Maryland Dorchester County, To wit on this seventh day of February in the year of eighteen hundred and forty four before me the subscriber one of the Justices of the Peace of the said state in and for the County aforesaid appeared James Wheatley and acknowledges the foregoing writing to be his act and deed according to the true intent and meaning thereof and the Act of Assembly in such case made and provided. Geo. A. Z. Smith J. Dougherty & C.o Be it remembered that the following Mortgage Bill from Ex.d of sale was recorded on the 4.th day of April 1844, To wit: John W. Dashiell Know all men by these presents that I John W. Dashiell of Dorchester County and State of Maryland for and in consideration of the sum of one hundred dollars lawful money of the United States in hand paid by J. Dougherty & C.o of Somerset County of the state aforesaid at or before the sealing & delivery of these presents the receipt whereof is hereby acknowledged: Have granted, bargained and sold and by these presents do grant, bargain and sell unto the said J. Dougherty & C.o their heirs, executors, administrators and assigns, one Sulkey and one Black Mare Now the Conditions of this Bill of Sale or instrument of writing are such that if the said J. W. Dashell shall well and truly pay unto J. Dougherty & C.o the sum of fifty dollars on or before the 9.th day of June next (1844) and the further sum of fifty dollars on or before the 9.th day of September next (1844) then this instrument to be of no avail or effect in law otherwise to have full force and virtue.
