198 of the said premises and for and consideration of the further sum of one dollar to him in hand paid by the said Henry W. Hicks before the sealing and delivery of these presents the receipt whereof the said Martin M. Dean doth hereby acknowledge and therefrom doth hereby acquit release and forever discharge the said Henry W. Hicks his heirs, executors and administrators and every of them by these presents hath granted, bargained and sold and doth hereby grant, bargain and sell unto the said Henry W. Hicks his Executors, administrators and assigns a certain Negro called "John" about fourteen years of age (which said Negro John the said Martin M. Dean holds as Mortgages of the aforesaid Samuel M.cCollester) To have and to hold the said Negro "John" hereby bargained and sold unto the said Henry W. Hicks his executors, administrators and assigns forever; Provided Always and these presents are upon the condition that if the said Martin M. Dean or the aforesaid Samuel M.cCollester shall well and truly pay or cause to be paid unto the said Henry W. Hicks his heirs or assigns the full sum of seven hundred dollars with interest and all cost on or before the first day of March in the year one thousand eight hundred and forty six then and in that case these presents shall cease and be utterly void to all intents and purposes. And the said Henry W. Hicks doth hereby promise and agree to permit the said Martin M. Dean (Mortgagee of said Samuel M.cCollester) to have the controll and profits of said Negro John till the Maturity of said bonds or obligation herein before refered to. In testimony whereof the said Martin M. Dean hath hereunto affixed his hand and seal this day and year first above written Signed, sealed & delivered in the presence of William Newton Martin M. Dean (Seal) State of Maryland, Dorchester County sc Be it remembered that on this second day of March in the year of our Lord one thousand eight hundred and forty four personally appears Martin M. Dean the party grantor herein before mentioned and acknowledges the within Mortgage Bill of Sale or instrument of writing to be his act and deed and the property therein refered to be the right and estate of Henry W. Hicks the party grantee also therein named his heirs and assigns according to the purport, true intent and meaning of said Mortgage Bill of Sale or instrument of writing and the Act of Assembly in such case made and provided. Taken and Certified the day and year first above written William Newton Joel Cornwell Be it remembered that the following Bill of Sale was recorded from Ex.d on the 1.st day of April 1844, To wit: W.m W. Hooper Know all men by these presents that I William W. Hooper of Dorchester County and state of Maryland for and in consideration of the sum of fifty dollars lawful mony of the United States in hand paid by Joel Cornwell of the County and State aforesaid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted, bargained and sold and by Del.d J Cornwell 13 Jany 1844 |
