143 Hester Handley Be it remembered that the following Bill of Sale was recorded Ex.d from 17th July 1843 to wit This Indenture made this Francis Webb fourteenth day of July anno Domini one thousand eight hundred and forty three by and between Francis Webb of Dorchester county and state of Maryland of the one part and Mrs Hester Handley widow of the county and state aforesaid of the other part witnesseth that whereas the said Francis Webb in and by certain obligations and mortgages in writing under his hand and seal given some short time since to the aforesaid Mrs Hester Handley standeth bound unto the said Mrs Hester Handley in several large sums of money conditioned for the payment of certain sums of money therein mentioned and expressed being for the purchase money of the farm whereon the said Francis Webb now resides and for lawful intent thereon reference to the said bonds and Mortgages will more fully and at large appear Now this Indenture witnesseth that the said Francis Webb as well for and in consideration of the aforesaid bonds and mortgages and for the better securing the payment thereof with interest unto the said Mrs Hester Handley her heirs executors administrators and assigns in discharge of the said bonds and mortgages as of the further sum of five dollars to him the said Francis Webb in hand well and truly paid by the Mrs Hester Handley at and before the sealing and delivery hereof the receipt whereof is hereby acknowledged hath granted bargained sold and confirmed and by these presents doth grant bargain sell and confirm unto the said Mrs Hester Handley her heirs and assigns all the crops of maize or indian corn and potatoes and wheat and oats and other small grain of every Kind which may be now growing or is already matured and harvested on and upon the Farm whereon the said Francis Webb now resides To Have and to Hold the said crops of maize or indian corn potatoes wheat oats and other small grain of every Kind as aforesaid to the only proper use and behoof of the said Mrs Hester Handley her heirs and assigns forever Provided always nevertheless that if the said Francis Webb his heirs executors or administrators shall and do well and truly pay or cause to be paid unto the said Mr.s Hester Handley the aforesaid bonds and Mortgages or the amount of money intended thereby to be secured with interest thereon without defalcation or abatement of any Kind then and from thence forth this present indenture and all matters and things therein contained shall be absolutely null and void any thing therein contained to the contrary notwithstanding In witness whereof the said Francis Webb has hereunto set his hand and seal the day and year first above mentioned signed sealed and delivered in presence of Geo A.th Smith Francis Webb (seal) Dorchester County State of Maryland ^s/t^ On this 14th day of July 1843 before the subscriber a Justice of the peace in and for the county and state afs.d personally appeared Francis Webb who made acknowledgment that the within deed of Indenture or instrument of writing is his act and deed for the true intent and purposes therein mentioned Geo A.th Smith (JP) Del.s Thos Stare 11 Oct 1843 |
