and appurtenances aforesaid and to grant bargain seal and dispose of the same and
all other the premises aforesaid at Public Auction or vendue in the City of Baltimore or
elsewhere first giving ten days notice of the time and place of such sale and as the attorney
of the said James Smith or otherwise to make sign seal execute and deliver to the purchaser
or purchasers thereof a good and Sufficient Bill of Sale or other Conveyance therefor and
out of the monies arising from such sale to retain all such sum or sums of money and
Interest which shall then be due on the three herein before mentioned Promissory notes
according to the true intent and meaning thereof together with all costs and expenses
attending such sale rendering the overplus money (if any) to the said James Smith
his executors administrators or assigns  In Witness Whereof I have hereunto set my
hand and seal this First day of June in the year of our Lord one thousand eight
Hundred and forty three

Justices of the peace of the State of Maryland in and for said city appeared
James Smith above named and acknowledged the foregoing Mortgage or
Instrument of writing to be his act and deed according to the true intent and
meaning thereof and the acts of assembly in such Cases made and provided
             Acknowledged before & Certified by               J Walsh

State of Maryland           I hereby certify that Jacob Walsh Esquire before
Baltimore County sct      whom the aforegoing acknowledgment was made
and who hath thereto subscribed his name and was at the time of so doing a
Justice of the Peace of the State of Maryland in and for the City of Baltimore
duly commissioned and sworn
                               In testimony whereof I hereto set my hand and
       (Seal)               affix the seal of Baltimore County Court on this 3.d day

State of Maryland      Be it remembered that the following Bond was recorded
Ex.d         from          31st May 1843 to wit      Know all men by these presents
William B Dail           that we William B Dail Thos H Hicks of Dorchester
county in the state of Maryland are held and firmly bound unto the state
of Maryland in the full and just sum of Seven hundred and Thirty four
dollars and sixty six cents current money of the United States to be paid
to the said State or its certain attorney to the which payment well and
truly to be made and done  We bind ourselves and each of us our and
each of our heirs Executors and administrators jointly and severally
firmly by these presents sealed with our seals and dated this 31st day of may
