129 (Seal) the present year as per Master Carpenters Certificate dated the 7th Sep year afsd a new Schooner And the said James Smith having certified that the said ship a vessel has one Deck and two masts and that her length is Sixty feet six Inches her breadth Twenty feet six inches her Depth five feet and that she measures Fifty two tons & 5/95 part of a ton that she is a schooner has a square stern no Galleries and no figure head and the said owner having agreed to the description and admeasurement above specified and sufficient security having been given according to the said Act the said schooner has been duly enrolled at the port of Oxford Given under my hand and seal at the port of Oxford this Eighth day of September in the year one thousand eight hundred & forty two 1842 To have and to hold the said Schooner or vessel Called the Benjamin Le Compte of Oxford and appurtenances thereunto belonging unto the said James Hooper John P Hooper and James Hooper Jr their executors administrators and assigns to the only proper use and behoof and as the proper goods and chattels of the said James Hooper John P Hooper and James Hooper Jr their executors administrators and assigns from henceforth forever and I the said James Smith for my self my Executors and administrators do hereby covenant and agree to and with the said James Hooper John P Hooper and James Hooper Jr their executors administrators and assigns that at the execution of these presents I the true and lawful owner of the said Schooner or vessel called the Benjamin Lecompte of Oxford and appurtenances and I have full right and authority to sell and dispose of the said freed from and cleared of all claims incumbrances or demands whatsoever Provided always and these presents are upon this condition Nevertheless that if the said James Smith his executors or administrators shall well and truly pay or cause to be paid unto the said James Hooper John P Hooper and James Hooper Jr their executors administrators or assigns the sum of seven hundred 3/100 Dollars lawfull money of the United States of America and Interest thereon till paid as mentioned and set forth in the three herein before described Promissory notes given by the said James Smith to the said James Hooper & Sons as the same shall respectively become due and payable that then and from thenceforth these presents and every thing herein contained shall cease and determine and be absolutely void otherwise to be and remain in full force and virtue And it is hereby covenanted and agreed by and between the parties to these Presents that if default shall be made in the payment of the said sum of seven hundred 3/100 Dollars with Interest thereon till paid as mentioned and set forth in the three herein before described Promissory notes as the same shall respectively become due and payable or any part thereof that then and from thence forth it shall be lawful for the said James Hooper John P Hooper and James Hooper Jr their executors administrators or assigns to enter upon and take possession of the said schooner or vessel her masts Yards sails Rigging Anchors Cables boats Tackle Apparel |
