(1988 Replacement Volume and 1992 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 73B - Pensions

1-103.

(a)     The responsibility for the general administration and proper operation of the
several systems is vested in the Board of Trustees for Maryland State Retirement and
Pension Systems. The Board shall consist of the following 15 members:

(1)     The State Comptroller, ex officio;

(2)     The State Treasurer, ex officio, who may appoint, as the Treasurer's
designee, a deputy treasurer;

(3)     The Secretary of Budget and Fiscal Planning, ex officio;

(4)     The Secretary of Personnel, ex officio;

(5)     The State Superintendent of Schools, ex officio;

(6)     The Superintendent of State Police, ex officio;

(7)     2 trustees who are members or retirees of the Employees' Retirement
System or the Pension System for Employees of the State of Maryland, not more than 1
of whom may be a retiree of either system at the time of election under subsection (b) of
this section, and neither of whom may be an employee of the State Retirement Agency or
the State Investment Agency;

(8)     2 trustees who are members or retirees of the Teachers' Retirement
System or the Pension System for Teachers of the State of Maryland, not more than 1 of
whom may be a retiree of either system at the time of election under subsection (b) of this
section;

(9)     2 trustees who are members or retirees of the State Police Retirement
System of Maryland, not more than 1 of whom maybe 1 IS a retiree of the system AT THE
TIME OF ELECTION UNDER SUBSECTION (B) OF THIS SECTION;

(10)   1 trustee who shall represent the interests of local governments
participating in the Employees' Retirement System and the Pension System for
Employees of the State of Maryland; and

(11)   2 trustees knowledgeable in the administration and operation of pension
systems and trust funds who shall represent the interests of the general public and who
are not members of any of the several systems.

(b)     (1) Trustees who serve in an ex officio capacity shall serve for the duration
of their respective terms in office and any extensions of their terms.
