SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 88B - State Police
23B.
(a) IN THIS SECTION, "NONEXEMPT." MEANS BEING ENTITLED TO PAY FOR
OVERTIME WORK UNDER THE FEDERAL FAIR LABOR STANDARDS ACT.
(B) If authorized by the Superintendent, a NONEXEMPT law-enforcement
employee[, cadet,] or a 40-hour [workweek] NONEXEMPT civilian employee of the
Maryland State Police shall work [a] AN ALTERNATIVE 10 hour workday [alternative
work schedule] in lieu of an 8 hour workday [and 5 day workweek].
(b) [The Maryland State Police may implement a trial 10 hour day alternative
work schedule for a 2 year period with certain units selected by the Superintendent.]
(c) [Law] NONEXEMPT LAW enforcement and [cadet] NONEXEMPT CIVILIAN
participants in the alternative [work schedule] WORKDAY program will be exempt from
the overtime compensation requirements of Article 89, § 27 [(d)(1)] (E)(1) of the Code.
Overtime compensation for NONEXEMPT law enforcement [and cadet] program
participants shall be computed on a daily basis, by dividing the daily rate of compensation
by the number of hours in the workday and multiplying the resulting quotient by one and
one-half times the number of hours worked in excess of the alternative 10 hour workday.
Forty-hour [workweek] NONEXEMPT civilian employees who participate in the
alternative [work schedule] WORKDAY program [are exempt from the overtime
compensation requirements of Article 89, § 27 of the Code and] shall be paid at a rate of
one and one-half times the regular rate for hours worked in excess of 10 in any day or one
and one-half times the regular rate for hours worked in excess of [80] 40 in any [fixed
2-week] ESTABLISHED work period of [14] 7 consecutive days, whichever overtime
computation is greater. PERSONAL LEAVE FOR THESE EMPLOYEES SHALL BE BASED
ON AN 8-HOUR WORKDAY.
[(d) During the 2 year period the alternative work schedule will be evaluated for
efficiency, productivity, energy consumption, and quality of services.]
SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

(c) (1) THIS SUBSECTION APPLIES TO LAW ENFORCEMENT AND CIVILIAN
EMPLOYEES OF THE MARYLAND STATE POLICE WHO PARTICIPATE IN THE
MODIFIED WORKDAY PROGRAM ESTABLISHED IN ACCORDANCE WITH ARTICLE 88B,
§ 23B OF THE CODE.
