AN ACT concerning

Development Regulations in the Chesapeake Bay Critical Area

FOR the purpose of establishing regulations for the
development of land in the critical area; providing that places
for development shall be reviewed by the Department of
Environmental Protection and Resource Management; providing for
required findings in the CRG process; providing for recording
restrictions on use of property; providing for preservation of
open space areas in accordance with the critical areas finding
plan or protection covenants for maintenance of the land;
providing for plat recordation after approval of evidence of
recording findings plan; providing for waiver after findings by
director of environmental protection; providing for information
contained on the critical area findings plan; providing for
referral to the planning board after a request for waiver and the
time for rendering a decision and required findings; providing
for recordation of finding; providing additional definitions for
the critical area; providing for overlay areas to implement
intensely developed areas and limited development areas;
providing for critical area findings plan and procedure for
review; providing for clustering; providing for protection of
wetlands, buffers and cutting of trees or vegetation; providing
for habitat protection; providing for development in intensely
developed areas and limited development areas; providing for
procedures for water-dependent facilities; providing procedure
for use and occupancy permits; providing administration and
enforcement of violations, criminal and civil penalties, appeals,
expenses caused by violation and certain additional remedies.

BY repealing and reenacting

Section 22-40, 22-53, 33-54, 22-56, 22-58(b)(1), 22-66(a),

(b), 22-67(a)
Sections 22-40, 22-53, 22-54, 22-56, 22-58(b)(l), 22-66(a),

(b), 22-67(a)
