VETOES

Pensions - Partial Withdrawal of a Participating Municipal

Corporation

FOR the purpose of permitting a municipal corporation whose
employees participate in the State employees' retirement or
pension systems to withdraw and transfer under certain
circumstances certain groups of employees to a local
retirement system.

BY repealing and reenacting, with amendments,

Article 73B - Pensions

Section 168(a)

Annotated Code of Maryland

(1983 Replacement Volume and 1986 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 73B - Pensions

168.

(a) (1) The legislative body of any municipal corporation
whose employees are members of the employees' retirement or
employees' pension systems may withdraw [its employees who
consent to the withdrawal,] and transfer [these employees] to a
local retirement system established by the municipal corporation
THE FOLLOWING MUNICIPAL EMPLOYEES WHO CONSENT TO THE WITHDRAWAL:

(I)  ALL EMPLOYEES OF THE MUNICIPAL CORPORATION;

(II)  FIREFIGHTERS;

(III)  LAW ENFORCEMENT PERSONNEL; OR

(IV)  SUBJECT TO THE APPROVAL OF THE BOARD OF
TRUSTEES, ANY HOMOGENEOUS UNIT OF AT LEAST 10 EMPLOYEES.

(2) The withdrawal and transferal shall become
effective only at the end of the fiscal year, namely, June 30.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.
